OR OTHER UNIT OF LOCAL <br />16 GOVERNMENT, MAY BE A HOLDER, AN ENVIRONMENTAL COVENANT MAY <br />17 IDENTIFY MORE THAN~ ONE HOLDER, THE INTEREST OF A HOLDER IS AN . <br /> <br />18 INTEREST IN REAL PROPERTY. THE DEPARTMENT DOES NOT BECOME A <br /> <br />19 HOLDER MERELY BY SIGNING AN ENVIRONMENTAL COVENANT, AND ITS <br />20 INTEREST AS A SIGNATORY PARTY DOES NOT CREATE AN INTEREST IN REAL <br />21 PROPERTY. <br /> <br />22 <br /> <br />(6) A PERSON THAT SIGNS AN ENVIRONMENTAL COVENANT IS <br /> <br />23 BOUND BY THE OBLIGATIONS THE PERSON ASSUMES IN THE COVENANT, BUT <br />24 SIGNING THE COVENANT DOES NOT CHANGE OBLIGATIONS, RIGHTS, OR <br />25 PROTECTIONS GRANTED OR IMPOSED UNDER LAW OTHER THAN THIS <br />26 SUBPART 2 EXCEPT AS PROVIDED IN THE COVENANT. <br /> <br />27 <br /> <br />(7) THE FOLLOWING RULES APPLY TO INTERESTS IN REAL PROPERTY <br /> <br />. <br /> <br />-12- <br /> <br />SB05-246 <br />
