<br />AND RANCHERS EMERGENCY NATURAL DISASTER ASSISTANCE FUND CREATED IN SECTION 35-1-114, C.R.S., FOR <br />THE PURPOSE OF PROVIDING FARMERS AND RANCHERS WITH EMERGENCY ASSISTANCE IN THE CASE OF A <br />NATURAL DISASTER DUE TO DROUGHT: HOWEVER. IN NO EVENT SHAl.l. THE AGGREGATE AMOUNT OF MONEY <br />TRANSFERRED IN ACCORDANCE WITH THIS PARAGRAPH (ll) EXCEED ONE MILLION DOLLARS. <br />SECTION 40 Transfer of funds - appropriation. (1) Notwithstanding any provision of section <br />39-29-109 (I), Colorado Revised Statutes, to the contrary, on August I, 2002, the state treasurer shall deduct such <br />amounts from the neroetual hase account of the severance tax trust fund created in section 39-29-109 (1) (a) (1), <br />Colorado Revised Statutes, as directed bv the commissioner of allriculture in accordance with section 39-29-109 <br />(n (ll) Colorado Revised Statutes. and transfer such sum to the farmers and ranchers emergency natural disaster <br />assistance fund created in section 35-1-114, Colorado Revised Statutes. <br />(2) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the <br />farmers and ranchers emergency natural disaster assistance fund created in section 35-1-114, Colorado Revised <br />Statutes, not otherwise appropriated, to the department of agriculture, for the fiscal year beginning July 1, 2002, <br />the sum of = the amounts transferred bv the state treasurer in accordance with section 39-29-109 (n (ll), <br />Colorado Revised Statutes. or so much thereof as may be necessary, for the purpose of providing farmers and <br />ranchers with emergency assistance in the case of a natural disaster due to drought. <br />SECTION 50 Safety clause. The general assembly hereby finds, determines, and declares that this act <br />is necessary for the immediate preservation of the public peace, health, and safety. <br /> <br />52 <br />
