<br />12 <br />13 <br /> <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />1 <br /> <br />DAMS KEEP RECORDS OF AND REPORT ON THE MAINTENANCE, OPERATION, <br />STAFFING, AND ENGINEERING AND GEOLOGIC INVESTIGATIONS <br /> <br />2 <br /> <br />3 CONCERNING RESERVOIRS AND SHALL ISSUE ORDERS AS NECESSARY TO <br />4 INSURE ADEQUATE MAINTENANCE AND OPERATION AND TO REQUIRE <br />5 ADEQUATE STAFFING AND ENGINEERING AND GEOLOGIC INVESTIGATIONS <br /> <br />6 <br />7 <br />8 <br />9 <br />10 <br /> <br />WHICH WILL SAFEGUARD LIFE AND PROPERTY. IN ADDITION, THE <br />OWNER OF A DAM OR RESERVOIR SHALL FULLY AND PROMPTLY ADVISE <br />THE STATE ENGINEER OF ANY SUDDEN OR UNPRECEDENTED FLOOD OR <br />UNUSUAL OR ALARMING CIRCUMSTANCE OR OCCURRENCE AFFECTING THE <br />DAM OR RESERVOIR. <br /> <br />11 <br /> <br />SECTION 4. Article 87 of title 37, Colorado Revised <br />Statutes 1973, as amended, is amended BY THE ADDITION OF THE <br />FOLLOWING NEW SECTIONS to read: <br /> <br />37-87-108.5. Periodic inspections - unsafe conditions. <br />(1) The state engineer, from time to time, shall make <br /> <br />inspections ,of dams and reservoirs for the purpose of <br /> <br />17 determining their safety but shall require owners to perform, <br />18 at their expense, such work as is necessary to disclose <br />19 information sufficient to enable the state engineer to <br /> <br />20 determine conditions of dams and reservoirs in regard to their <br /> <br />21 safety and to perform other work necessary to safeguard life <br /> <br />22 and property. <br />23 (2) The state engineer shall immediately employ any <br />24 remedial means necessary, including the lowering of a <br />25 reservoir level, to protect life and property if either: <br /> <br />26 <br /> <br />(a) The condition of any dam or <br /> <br />reservoir is <br /> <br />so <br /> <br />-6- <br /> <br />15 <br /> <br />- <br /> <br />~j <br />:j <br />f,~ <br />" <br />" <br />~ : <br />t-r' <br />~c <br />~- <br />~~-' <br />~--j <br />e"."".."" <br />" <br />, i <br />:,"~:~..- <br /> <br /> <br />t; <br /> <br />....._- --.,-......,.- <br />
