<br />(I) Is or will be ten feet or more in height from the

<br />natural bed of the stream or watercourse at the downstream toe

<br />4 of the barrier, as determined by the state engineer, or from

<br />5 the lowest elevation of the outside limit of the barrier, as

<br />6 determined by the state engineer, if it is not across a stream

<br />7 channel or watercourse, to the maximum possible water storage

<br />(II) Has or will have an impounding capacity of fifty
<br />
<br />acre-feet or more.
<br />
<br />(b) "Dam" does not include an obstruction in a canal
<br />used to raise or lower water therein, a levee, a railroad fill
<br />
<br />or structure, a road or highway fill or structure, a livestock
<br />
<br />
<br />water tank, as defined in section 35-49-103, C.R.S. 1973, or
<br />
<br />
<br />an erosion control dam as defined in section 37-87-122.
<br />
<br />(3) "Enlargement" means any change in or addition to an
<br />existing dam or reservoir which raises or may raise the water
<br />
<br />18 storage elevation of the water impounded or which increases
<br />
<br />19 the volume of water which may be impounded.

<br />(4) (a) "Owner" means any of the following who own,
<br />
<br />21 control, operate, maintain, manage, or propose to construct a
<br />
<br />22 dam or reservoir:

<br />(I) The
<br />
<br />state and its departments,
<br />
<br />divisions,
<br />
<br />24 institutions, agencies, and political subdivisions;

<br />(II) A municipal or quasi-municipal corporation or
