after consultation with private insurers, whether a meeting of
the special committee should be held to determine whether the

3 conditions specified in subsection (1) of this section for the

4

creation of the fund have been met.

Nothing in this

5 subsection (2) shall be construed to prohibit the special

6 committee from meeting at the request of any member of the

7 special committee or at the request of any person or group of
8 persons who alleges that the unavailability of reservoir
9 liability insurance coverage to be provided by the fund

warrants the creation of the fund.

10-4-1203.

Coverage for liability

of basic

(1)

Every reservoi r

owner who

elects to be covered by the fund must first obtain

reservoir liability insurance in the amount of fifty thousand

dollars per occurrence

and

No insurer providing reservoir

insurance

to a reservoir

owner who is covered by the fund pursuant to

the provisions of subsection (1)

of this

secti on shall

liable for payment of any claim against such reservoir owner

22 dollars per occurrence and one million dollars per annual

23 aggregate.

(3) After the special committee makes the findings

25 required by section 10-4-1202, there shall be created a
26 reservoir liability extraordinary loss fund for the purpose of
