Participation <br /> <br />of <br /> <br />association members <br /> <br />2 assessments - methods of recoupment. (1) All members of the <br />3 association shall contribute to the financial requirements of <br />4 the association in the proportion that the net direct premiums <br /> <br />5 <br /> <br />written by each such member (excluding that portion of <br /> <br />6 <br /> <br />premiums attributable to the operation of the association) <br /> <br />7 <br /> <br />during the preceding calendar year bear to the aggregate net <br /> <br />8 <br /> <br />direct premiums written in this state by all members of the <br /> <br />9 <br /> <br />association. Each member's participation in the association <br /> <br />shall be determined annually on the basis of such net direct <br /> <br />premiums written during the preceding calendar year, as <br /> <br />reported in the annual statements and other reports filed by <br /> <br />such member with the commissioner. <br /> <br />(2) In the event that sufficient funds are not available <br /> <br />for the sound financial operation of the association, the <br /> <br />board shall determine'the amount of additional funds necessary <br /> <br />for the sound financial operation of the association and shall <br /> <br />assess the members of the association on the basis of their <br /> <br />19 participation in the association as provided in this section. <br /> <br />20 <br /> <br />21 <br /> <br />Each member shall be notified of the assessment not later than <br /> <br />sixty days before it is due. If the immediate full payment of <br /> <br />22 the assessment would place any member in noncompliance with <br /> <br />23 <br /> <br />the financial requirements of this title, such member may <br /> <br />24 petition the commissioner to defer, in whole or in part, its <br /> <br />25 assessment then due.
