association as a condition of its authority to continue to

make contracts of such ki nd of insurance in th,i s state.

(2) The purpose of the association shall be to provide

4 for a market for reservoir liability insurance on a

5 self-supporting basis without subsidy from its members.

(3) (a) The association shall not commence underwriting

7 operations for any reservoir owner until the commissioner,

8 after notice and an opportunity for a hearing, finds that

reservoir liability insurance is not available or as of a

determinable date will not be available for all types or

categories of reservoirs in the voluntary market or that the

cost of such insurance is so unreasonably expensive as to be

practicably unavailable.
(b) If the commissioner determines, after notice and an
opportunity for a hearing, that adequate reservoir liability
insurance is available in the voluntary market for 'any
specific type or category of reservoir, the association shall
thereby cease its underwriting operations for such type or

19 category of reservoir.

(4) (a) The association shall, pursuant to the

21 provisions of this part 11 and the plan of operation with

22 respect to reservoir liability insurance, have the power on

23 behalf of its members:

24

(I) To issue, or cause to be issued, policies of

25 reservoir liability insurance, including liability coverages

26 normally incidental thereto, to owners of reservoirs in the
