<br />14 <br /> <br />15 <br />16 <br /> <br />1 <br /> <br />including all enlargements thereto, substantially completed by <br />or in operation on June 30, 1983, and on June 30 of each <br /> <br />2 <br /> <br />3 <br /> <br />succeeding year. <br /> <br />The annual fee shall be fifty dollars plus <br /> <br />4 one dollar per foot of height of the dam. <br /> <br />5 <br />6 <br />7 <br /> <br />(b) For purposes of this subsection (1), "height of the <br /> <br />dam" means the vertical distance, to the nearest ifoot, from <br /> <br />the natural bed of the stream or watercourse at the downstream <br /> <br />8 <br /> <br />toe of the barrier, as determined by the state engineer, or <br /> <br />9 <br />10 <br /> <br />from the lowest elevation of the outside limit of the barrier, <br /> <br />as deter~ined by the state engineer, if it is not across a <br />stream channel or watercourse, to the maximum possible water <br /> <br />11 <br /> <br />12 <br />13 <br /> <br />storage elevation. <br /> <br />(2) All moneys collected under subsection (1) of this <br />section and section 37-80-110 (1) (e) (I) shall be transmitted <br /> <br />to the state treasurer who shall credit the same to the dam <br /> <br />inspection fund, which fund is hereby created. <br /> <br />All moneys' <br /> <br />17 credited to said fund and all interest earned on such moneys <br /> <br />18 shall be used for paying the expenses of the dam safety <br /> <br />19 <br /> <br />program as appropriated by the general assembly. <br /> <br />Any <br /> <br />20 unexpended balance remaining in the dam inspection fund at the <br />21 end of each fiscal year shall remain in the fund and become <br />22 available for appropriation during the following fiscal year. <br />23 The controller, upon presentation of vouchers properly drawn <br />24 and signed by the state engineer, or an authorized employee of <br /> <br />25 the division of water resources, shall issue warrants drawn on <br /> <br />26 said fund, in accordance with any appropriation made by the <br /> <br />-12- <br /> <br />15 <br /> <br />e <br /> <br />~ <br />~ r~,' <br />.".j <br />t-' <br />-" .~ <br />:.;j <br /> <br />~~J <br />l-ejj <br />~' <br />~ <br />,,_,'~f <br />,', " <br />,v <br /> <br />- <br />
