Penalty - disposition of fines. Any <br /> <br />reser~oir--eom~any OWNER failing or refusing, after ten days' <br /> <br />3 notice in writing has been given, to obey the directions AND <br /> <br /> <br />4 ORDERS of the state engineer as to the construction or fi11ing <br /> <br />5 <br />6 <br /> <br />OPERATION of any reservoir shall be subject to a fine of not <br /> <br />less than two h~ndred THOUSAND dollars for each offense, and <br /> <br />7 <br /> <br />each day's continuance after time of notice has expired shall <br /> <br />8 <br /> <br />be considered a separate offense. <br /> <br />Such fines shall be <br /> <br />recovered by civil action in the name of the people, by the <br /> <br />district attorney, upon the complaint of the state engineer, <br /> <br />in the county where the injury complained of occurred. The <br /> <br />proceeds of all fines, after payment of costs and charges of <br /> <br />the proceedings, shall be paid into the county treasury for <br /> <br />the use of the general fund of the county. <br /> <br />SECTION 9. 37-87-117, Colorado Revised Statutes 1973, as <br /> <br />amended, is amended to read: <br /> <br />18 has a maximum hei ght of ten feet or 1 ess, or wi 11 create a <br /> <br />37-87-117. Landowner to submit plans. If any such dam <br /> <br />19 reservoir having a s~rfaee-area-of-twenty-aeres--or--1ess.--or <br /> <br />20 has--a capacity of sixty-fi~e FIFTY acre-feet or,less, the <br /> <br />21 landowner desiring to take advantage of sections 37-87-116 to <br /> <br />22 37-87-121 shall first submit to the state engineer sufficient <br /> <br />23 engineering data, in the way of maps and plans, to show the <br /> <br />24 location, type, and dimensions of the proposed dam, reservoir, <br />25 and spillway and character of the foundation and of the <br /> <br />26 <br /> <br />materials available for construction purposes. <br /> <br />The state <br /> <br />-10- <br /> <br />15 <br /> <br />o <br /> <br />I <br />, I <br />, i <br />I <br />, , <br />, i <br /> <br />~, <br />'~ --:, <br />~.". <br />t-" <br /> <br />iJirtJ, <br />~ <br />
