By Senators Anderson, Chance, Locke. Noble, and Wunsch: also Representa- <br />tives McCormick. Hinman, McNeil, Quinlan, Arnold. Baer, Carroll, DeMoulin, Gustafson, <br />R. Jackson, Koster, Lamm. Safran. Schmidt, and Sonnenberg. <br /> <br />AN ACT <br /> <br />CONCERNING WATER, AND PROVIDING FOR A WATER PRO- <br />JECTS CONSTRUCTION FUND. <br /> <br />'- <br /> <br />Be it enacted by tke General Assembly of tke State of Colorado: <br /> <br />Section 1. 149-1-11, Colorado Revised Statutes 1963, as amended, is <br />amended BY THE ADDITION OF THE FOLLOWING NEW SUBSEC- <br />TIONS to read: <br /> <br />149-1.11. Duties of the board. (13) To enter into contracts as <br />hereinafter provided for the construction of conservation projects which <br />as authorized - by the general assembly under procedures set forth in <br />section 149-1-22 will conserve and utilize for the best advantage of the <br />people of this state the water and power resources of the state, includ- <br />ing projects beyond the boundaries of the state of Colorado located on <br />interstate waters when the benefit of such project accrues to the citi- <br />zens of the gtate of Colorado, upon application under such rules and <br />regulations as the board shall establish. <br /> <br />(14) To file applications in the name of the department of natural <br />resources for the appropriation of water. <br /> <br />(15) To take all action necessary to acquire or perfect water rights <br />for projects sponsored by the board. <br /> <br />(16) To sell or otherwise dispose of property owned by the board, <br />in the name of the state of Colorado, as a result of expenditures from <br />the water conservation board construction fund in such marmer as to <br />be most advantageous to the state. Proceeds from such sale or disposal <br />shall accrue to the water conservation board construction fund and <br />shall not revert to the general fund except that any balance in such <br />construction fund in excess of ten million dollars at the close of any <br />fiscal year shall revert to the general fund of the state. <br /> <br />Section 2.
