<br />EXTENSION OF WELL PERMITS PROVIDED FOR IN THIS SUBPARAGRAPH (I) <br />SHALL NOT APPLY TO WELL PERMITS FOR FEDERALLY AUTHORIZED WATER <br />PROJECTS CONTAINED IN PARAGRAPH (d) OF THIS SUBSECTION (3). THE <br />STATE ENGINEER SHALL CHARGE A FEE OF SIXTY DOLLARS FOR SUCH <br />EXTENSION. <br /> <br />e <br /> <br />SECTION 7. 37-90.5-106 (I), Colorado Revised Statutes, ]s <br />amended to read: <br /> <br />37-90.5-106. Drilling permits - reinjection - repeal. <br />(I) (a) (I) Prior to constructing a geothermal resource exploration, <br />production, or reinjection well, a permit tnttSt SHALL be obtained from the <br />state engineer. The state engineer shall adopt such rules a]1d Icgulatil)Il5 as <br />are necessary to protect the public helllth, safety, and welfare and the <br />environment and to prevent the waste of apy geothermal resource. THE FEE <br />FOR ISSUANCE OF A PERMIT PURSUANT TO THIS SECTION SHALL BE FOUR <br />HUNDRED FORTY DOLLARS; EXCEPT THAT AFTER THE EFFECTIVE DATE OF <br />THIS SECTION, AS AMENDED, the state engineer shaH MAY also adopt ALTER <br />SUCH FEE BY ADOPTING rules for the assessment of reasonable fees for the <br />processing and granting of a permit under this section. <br /> <br />(II) THIS PARAGRAPH (a) IS REPEALED, EFFECTIVE JULY 1,2006. <br /> <br />e <br /> <br />(b) EFFECTIVE JULY 1, 2006, PRIOR TO CONSTRUCTING A <br />GEOTHERMAL RESOURCE EXPLORATION, PRODUCTION, OR REINJECTION <br />WELL, A PERMIT SHALL BE OBTAINED FROM THE STATE ENGINEER. THE STATE <br />ENGINEER SHALL ADOPT SUCH RULES AS ARE NECESSARY TO PROTECT THE <br />PUBLIC HEALTH, SAFETY, AND WELFARE AND THE ENVIRONMENT AND TO <br />PREVENT THE WASTE OF ANY GEOTHERMAL RESOURCE. THE ST A TEENGINEER <br />SHALL ALSO ADOPT RULES FOR THE ASSESSMENT OF REASONABLE FEES FOR <br />THE PROCESSING AND GRANTING OF A PERMIT UNDER THIS SECTION. <br /> <br />SECTION 8. 37-92-602 (3) (a), (3) (d), and (5), Colorado Revised <br />Statutes, are amended to read: <br /> <br />37-92-602. Exemptions - presuqIptions - legislative declaration <br />- repeal. (3) (a) (I) (A) Wells ofthe type ide scribed in paragraphs (b) to (d) <br />of subsection (I) of this section may be cqnstructed only upon the issuance <br />of a permit in accordance with the provisions of this subsection (3).
