<br />WHEREAS, The presmnption of noninjury to other wells for such
<br />exempt wells that is reasonable and appropriate for wells in
<br />unconsolidated alluvial aquifers or oilier permeable porous-media
<br />aquifers may not necessarily be reasonable or appropriate for wells in
<br />fractured crystalline rock aquifers on small lots; and
<br />
<br />WHEREAS, The standards pursuant to which the state engineer
<br />has been directed to issue exempt well permits were based upon the best
<br />available evidence at ilie time, and our understanding of the hmited yield
<br />from fractured crystalline rock aquifers has developed over time; and
<br />
<br />WHEREAS, The limited quantity of water available in fractured
<br />crystalline rock aquifers indicates that it may be more appropriate to issue
<br />exempt well permits based on the size and l'roposed use of ilie lot, the
<br />yield of the formation, and other site-specific geologic characteristics
<br />rather ilian ilie date of subdivision of ilie lot; and
<br />
<br />WHEREAS, Consideration should be given to the development of
<br />this resource being appropriately monitored so as not to reduce aquifer
<br />water levels to the extent iliat hann to prior permitted well holders III ilie
<br />area will occur; now, ilierefore,

<br />Be It Resolved by the House of Representatives of the Sixty-fifth
<br />General Assembly of the State of Colorado, the Senate concurring
<br />herein:

<br />
<br />I. That consideration should be given to developing scientifically
<br />sound and comprehensive ground water studies to better understand the
<br />issues involved with fractured crystalline rock aquifers.
<br />
<br />2. That consideration should be given to the capacity and recharge
<br />potential of ilie resource and protection of vested water rights when
<br />uevoting tributary ground water in fractured crystalline rock aquifers to
<br />benefiCial use.
<br />
<br />3. That local governments should consider the yield from wells
<br />iliat pump from fractured crystalline rock aquifers and ilie cmnulative
<br />effect of all such wells when considering and approving applications for
<br />approval of zoning, a subdivision plat, a planned unit development, or
<br />oilier application for similar development.
<br />
<br />Be It Further Resolved, That a copy of this joint resolution be
<br />provided to the state engineer and the diVIsion of water resources, the
<br />Colorado water conservation board, the Colorado Municipal League,
<br />Colorado Counties, Inc., and ilie boards of county commissioners for ilie
<br />counties of Alamosa, Archuleta, Boulder, Chaffee, Clear Creek, Conejos,
<br />Costilla, Custer, Delta, Dolores, Douglas, Eagle, EI Paso, Fremont,
<br />Garfield, Gilpin, Grand, Gunnison, Hinsdale, Hnerfano, Jackson,
<br />Jefferson, Lake, La Plata, Larimer, Las Animas, Mesa, Mineral, Moffat,
<br />Montezuma, Montrose, Ouray, Park, Pitkin, Pueblo, Rio Blanco, Rio
<br />Grande, Routt, Saguache, San Juan, San Miguel, Summit, and Teller.
