<br />Ch.267 <br /> <br />Water and Irrigation <br /> <br />1301 <br /> <br />recharge programs, conducting ground water investigations, and for other <br />ground water related activities which are deemed necessary by the state engi- <br />neer in performing his statutory duties, subject to appropriation by the gen- <br />eral assembly. Data in the ground water data network shall be made available <br />to the public by the office of the state engineer as expeditiously as possible. <br /> <br />Section 2. 37-80-111.5 (2), Colorado Revised Statutes, as amended, is <br />amended to read: . <br /> <br />37-80-111.5. Fees - water data bank cash fund - division of water resources <br />publication cash fund - satellite monitoring system cash fund - ground water <br />management cash fund - created. (2) All moneys deposited in the water data <br />bank cash fund, the division of water resources publication cash fund, ef <br />the satellite monitoring system cash fund, OR THE DIVISION OF WATER <br />RESOURCES GROUND WATER MANAGEMENT CASH FUND pur- <br />suant to subsection (1) of this section, together with any interest earned <br />thereon, shall be deposited in the cash fund as provided in this section. <br /> <br />Section 3. 37-90-105 (2), Colorado Revised Statutes, is amended, and <br />the said 37-90-105, as amended, is further amended BY THE ADDITION <br />OF A NEW SUBSECTION to read: <br /> <br />37-90-105. Small capacity wells. (2) A fee of five SIXTY dollars shall <br />accompany any application for a NEW well permit under this section. A <br />FEE OF TWENTY DOLLARS SHALL ACCOMPANY ANY APPLICA- <br />TION FOR A REPLACEMENT WELL OF THE TYPE DESCRIBED IN <br />SUBSECTION (1) OF THIS SECTION. ' . <br /> <br />(3) The state engineer shall act upon an application flied under this <br />section within forty-five days after such filing and shall support his ruling <br />with a written statement of the basis therefor, and the provisions of article <br />4 of title 24, C.R.S., shall apply. <br /> <br />Section 4. 37-90-107 (3), Colorado Revised Statutes, is amended to read: <br /> <br />, 37-90-107. Application for use of ground water - pnblication of notice - <br />conditional permit - hearing on objections. (3) After the expiration of the <br />time for filing objections, if no such objections have been filed, the commis- <br />sionshall, if it finds that the proposed appropriation will not unreasonably <br />impair existing water rights from the same source and will not create unrea- <br />sonable waste, grant the said application, and the state engineer shall issue <br />a conditional permit to the applicant WITHIN FORTY-FIVE DAYS AFTER <br />THE EXPlBA TION OF THE TIME FOR FILING OBJECTIONS OR <br />WITHIN FORTY-FIVE DAYS AFTER THE HEARING PROVIDED FOR <br />IN SUBSECTION (4) OF THIS SECTION to appropriate all or a part of <br />the waters applied for, subject to such reasonable conditions and limitations. <br />as the commission may specify. . <br /> <br />Section 5. 37~90-116 (1) (a), (1) (c), and (1) (h), Colorado Revised Stat- <br />utes, as amended, are amended to read: <br /> <br />37-90-116. Fees. (1) (a) With an application for the use of ground <br />water, $30.00 $60.00, which sum shall not be refunded; <br /> <br />, (c) For issuing a permit to modify or replace an existing well, $10.00 <br />$60.00; .
