SHALL BE <br /> <br />SUBJECT TO ALL APPLICABLE FEDERAL. STATE. OR LOCAL LAWS AND <br /> <br />REGULATIONS, INCLUDING ANY SUBDIVISION REGULATION PROMULGATED <br /> <br />BY A LOCAL PLANNING JURISDICTION. <br /> <br />(2) (a) <br /> <br />THE DEVELOPMENT AND SUBDIVISION OF RURAL LANDS <br /> <br />SHALL BE LIMITED TO A MINIMUM LOT SIZE OF THIRTY-FIVE ACRES OR <br /> <br />COMPACT AND CLUSTERED DEVELOPMENT AS SPECIFIED IN SECTION <br /> <br />30-28-403, C.R.S.; EXCEPT THAT THIS PARAGRAPH (a) SHALL NOT BE <br /> <br />INTERPRETED TO PROHIBIT AN OWNER OF A SINGLE PARCEL OF PROPERTY <br /> <br />THAT WAS LAWFULLY CREATED PRIOR TO JANUARY 1,2001, ON LAND IN AN <br /> <br />UNINCORPORATED. RURAL AREA OUTSIDE OF AN URBAN SERVICE AREA <br /> <br />FROM CONSTRUCTING IMPROVEMENTS UTILIZING AN INDIVIDUAL SEPTIC <br /> <br />SYSTEM IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL PLANNING <br /> <br />JURISDICTION'S LAND USE REGULATIONS. NOTHING IN THIS PARAGRAPH (a) <br /> <br />SHALL BE CONSTRUED TO PROHIBIT THE CONSTRUCTION OF A CARETAKER <br /> <br />UNIT OR HOUSING FOR SUCH CARETAKER, IN CONJUNCTION WITH SUCH <br /> <br />SINGLE FAMILY RESIDENCE. AS MAY BE ALLOWED UNDER LOCAL <br />DEVELOPMENT REGULATIONS. THIS PARAGRAPH (a) SHALL NOT BE <br /> <br />CONSTRUED TO PERMIT THE OWNER OF MULTIPLE CONTIGUOUS PARCELS OF <br /> <br />LAND TOTALING LESS THAN THIRTY FIVE ACRES FROM CONSTRUCTING MORE <br /> <br />THAN ONE RESIDENTIAL DWELLING UNIT. THIS PARAGRAPH (a) SHALL NOT <br />BE CONSTRUED AS EXPANDING OR CREATING ANY VESTED RIGHTS. ALL <br /> <br />OTHER APPLICABLE FEDERAL. STATE. OR LOCAL LAWS AND ALL OTHER <br /> <br />APPLICABLE LAND USE REGULATIONS, INCLUDING SUBDIVISION <br /> <br />REGULATIONS PROMULGATED BY THE LOCAL PLANNING JURISDICTION. <br /> <br />SHALL APPLY IN THE CASE OF A SINGLE PARCEL OR ANY CLUSTERED <br /> <br />-40- <br /> <br />1225 <br />
