Disputes arising under the Act and in the land use process <br />in general should be resolved as quickly, efficiently, and <br />informally as possible, and with minimum cost to the <br />disputing parties. <br />. The general assembly does not intend to deprive any <br />landowner of any existing vested rights created by statute, <br />contract, or common law or of any property rights derived <br />from the state or federal constitutions or to abrogate any <br />contractual obligations of the state or any local governments <br />in implementing the Act. <br />In connection with the applicability provisions of the Act: <br />. Specifies that the terms of the Act are to apply t'O every <br />county or city and county the population of which ,~xceeds <br />a specified number and to counties and cities and counties <br />the population of which exceeds a specified number and <br />that have experienced a specified increase in population for <br />certain years. <br />. Specifies that the terms of the Act are to apply to each <br />municipality any part of which is located in a county <br />covered by the Act and the population of which exceeds a <br />specified number. <br />Specifies that its terms preempt inconsistent laws, ordinances, or <br />regulations adopted by any local government. <br />In connection with requirements in the Act pertaining to planning <br />by local governments: <br />. Requires each governing body that has not previously <br />established a planning commission to designate and <br />establish a planning commission before a specified time. <br />. Requires the planning commission of each planning <br />jurisdiction to recommend, and the governing body of the <br />planning jurisdiction to adopt, a master plan within a <br />specified time. <br />. Specifies that the schedule for adoption of the master plan <br />varies depending upon the population of the planning <br />jurisdiction. <br />. Authorizes any local government that has previously <br />adopted a master plan to continue to operate under any <br />provision of the plan that complies with the Act. Provides <br />that a master plan may incorporate separate pllans by <br />reference. <br />. Requires that, prior to approval of the master plan, and <br />subject to the moratoria provisions of the Act, a <br />development application shall be processed in accordance <br />with the planning jurisdiction's existing master plar, if any, <br />and existing land development regulations. <br />. Requires each planning jurisdiction to adopt regulations <br /> <br />-2- <br /> <br />'1 <br /> <br />1225 <br />
