<br />I Be it enacted by the General Assembly of the State of Colorado: <br />2 SECTION 1. 37-60-126 (ll) (a), Colorado Revised Statutes, is <br />3 amended to read: <br />4 37-60-126. Water use efficiency - urban water use efficiency <br />5 programs - relationship to state assistance for water facilities. <br />6 (II) (a) On and aft'l Apti125, 2003, Any new restrictive covenant that <br />7 prohibits or limits the installation or use of drought-tolerant vegetative <br />8 landscapes is prohibited. <br />9 SECTION 2. 37-96-103 (5) (b), Colorado Revised Statutes, is <br />10 amended to read: <br />11 37-96-103. Requirement of water conservation in landscaping <br />12 for certain public projects. (5) If the state facility or project involves <br />13 landscaping or maintenance of existing landscaping to enhance water use <br />14 efficiency, a landscaping plan shall be developed and implemented using <br />15 best management practices which shall include, but not be limited to: <br />16 (b) Insuring the use of efficient irrigation techniques and systems, <br />17 includingJ)!9!!~!!i!1g land~llpe irrigation betw_e~nJhe_hours_ofJ..La.xn. <br />18 and 3 p.m. 7 P.M.; employing the use of non potable water supplies and <br />19 water reuse, where such supplies and water reuse are available, for <br />20 irrigation of areas exceeding ten acres; and using seasonally variable <br />21 irrigation schedules which THAT match the evapotranspiration needs of <br />22 the plants being irrigated; <br />23 SECTION 3. 37-92-305, Colorado Revised Statutes, is amended <br />24 BY THE ADDITION OF A NEW SUBSECTION to read: <br />25 37-92-305. Standards with respect to rulings of the referee and <br />26 decisions of the water judge. (3.5) IN ORDER TO PROMOTE <br /> <br />-2- <br /> <br />HB04-1233 <br />
