<br />(8) (a) "Legal services" means the purchase of legal services from
<br />the department of law; however, up to ten percent of the amount
<br />appropriated for legal services may ins lead be expended for operating
<br />expenses, contractual services, and tuition for employee training. No funds
<br />shall be expended for legal services except those specifically appropriated
<br />for such purpose. The provision ofthis subsection (8) shall not apply to the
<br />departmen1s of education, higher education, transportation, and the risk
<br />management fund in the department of personnel.
<br />
<br />(b) "Payments to private counsel" means the purchase of legal
<br />services from any individual or enti1y other than the department of law. No
<br />funds shall be expended for payments to private counsel except those
<br />specifically appropriated for such purposes.
<br />
<br />(9) "Motor vehicle" means a motor truck designated three-quarters
<br />of one ton or less, automobile, or other self-propelled vehicle costing less
<br />than fifty thousand dollars.
<br />
<br />(10) "Operating expenses" means:
<br />
<br />(a) Supplies and materials, meaning i1ems that by their nature are
<br />consumable and that have a useful life of less than one year or that, after
<br />usage, undergo an impairment of, or a material change in, physical
<br />condition, including, but not limited to, books, periodicals, and educational,
<br />laboratory, medical, data processing, custodial, postal, office, photographic,
<br />and road maintenance supplies and materials;
<br />
<br />(b) Current charges, meaning charges for items or services not
<br />otherwise defined in this section for which a separate appropriation is not
<br />made, including, but not limited to, charges for utilities, trash removal,
<br />custodial services, telecommunications, data processing, advertising,
<br />freight, rentals of equipment and property, storage, parking, minor repair or
<br />maintenance, and printing and reproduc1ion, and insurance premiums, dues,
<br />subscriptions, casualty losses, commissions, royalties, interest, fees, fines,
<br />reimbursements, litigation-related expenses to the department of law for
<br />individual cases that exceed five hundred dollars, and payments of prizes,
<br />awards, and judgments other than to state employees as compensation;
<br />except that no funds appropriated for operating expenses may be expended
<br />for vehicle lease payments, leased space, or lease purchase unless otherwise
<br />authorized by law;
