<br />I SUCH REPRESENTATIVE SHALL BE CHOSEN BY THE GOVERNING BODY OF <br /> <br />2 SUCH PROVIDER AND SHALL BE ENTITLED TO CAST A NUMBER OF VOTES <br /> <br />3 EQUAL TO THE NUMBER OF SINGLE-FAMILY EQUIVALENT TAPS SERVED BY <br />4 THE WATER PROVIDER. <br /> <br />5 (2) THE NUMBER OF DIRECTORS ELECTED SHALL BE UP TO NINE, AS <br /> <br /> <br />6 ESTABLISHED BY THE PETITION. No MORE THAN ONE LESS THAN HALF OF <br /> <br />7 THE DIRECTORS MAY RESIDE IN THE SERVICE AREA OF OR REPRESENT ANY <br /> <br />8 SINGLE WATER PROVIDER. <br /> <br />9 SECTION 2. 37-90-137 (4) (b) (I), Colorado Revised Statutes, <br /> <br />10 is amended to read: <br /> <br />II 37-90-137. Permits to construct wells outside designated basins <br /> <br /> <br />12 - fees - permit no ground water right - evidence - time limitation - well <br /> <br /> <br />13 permits - repeal. ( 4) (b) (1) Permits issued pursuant to !his subsection <br /> <br /> <br />14 (4) shall allow withdrawals on the basis of an aquifer life of one hundred <br /> <br />15 years, SUBJECT TO REGULATION OF THE PUMPING RATE AND SCHEDULE BY <br /> <br /> <br />16 THE DENVER BASIN CONSERVANCY DISTRICT PURSUANT TO SECTION <br /> <br />17 37-45-203 (5) IF SUCH DISTRICT HAS BEEN ORGANIZED PURSUANT TO PART <br />18 2 OF ARTICLE 45 OF THIS TITLE. _______ <br />-------- <br /> <br />19 SECTION 3. Effective date. This act shall take effect at 12:01 <br /> <br />20 a.m. on the day following the expiration of the ninety-day period after <br /> <br /> <br />21 final adjournment of the general assembly that is allowed for submitting <br /> <br /> <br />22 a referendum petition pursuant to article V, section I (3) of the state <br /> <br />23 constitution (August 4,2004, if adjournment sine die is on May 5, 2004); <br /> <br /> <br />24 except that, if a referendum petition is filed against this act or an item, <br /> <br /> <br />25 section, or part ofthis act within such period, then the act, item, section, <br /> <br /> <br />26 or part, if approved by the people, shall take effect on the date of the <br /> <br /> <br />27 official declaration of the vote thereon by proclamation of the governor. <br /> <br />-7- <br /> <br />HB04-ll85 <br />
