I SUCH REPRESENTATIVE SHALL BE CHOSEN BY THE GOVERNING BODY OF

2 SUCH PROVIDER AND SHALL BE ENTITLED TO CAST A NUMBER OF VOTES

3 EQUAL TO THE NUMBER OF SINGLE-FAMILY EQUIVALENT TAPS SERVED BY
4 THE WATER PROVIDER.

5 (2) THE NUMBER OF DIRECTORS ELECTED SHALL BE UP TO NINE, AS

6 ESTABLISHED BY THE PETITION. No MORE THAN ONE LESS THAN HALF OF

7 THE DIRECTORS MAY RESIDE IN THE SERVICE AREA OF OR REPRESENT ANY

8 SINGLE WATER PROVIDER.

9 SECTION 2. 37-90-137 (4) (b) (I), Colorado Revised Statutes,

10 is amended to read:

II 37-90-137. Permits to construct wells outside designated basins

12 - fees - permit no ground water right - evidence - time limitation - well

13 permits - repeal. ( 4) (b) (1) Permits issued pursuant to !his subsection

14 (4) shall allow withdrawals on the basis of an aquifer life of one hundred

15 years, SUBJECT TO REGULATION OF THE PUMPING RATE AND SCHEDULE BY

16 THE DENVER BASIN CONSERVANCY DISTRICT PURSUANT TO SECTION

17 37-45-203 (5) IF SUCH DISTRICT HAS BEEN ORGANIZED PURSUANT TO PART
18 2 OF ARTICLE 45 OF THIS TITLE. _______

19 SECTION 3. Effective date. This act shall take effect at 12:01

20 a.m. on the day following the expiration of the ninety-day period after

21 final adjournment of the general assembly that is allowed for submitting

22 a referendum petition pursuant to article V, section I (3) of the state

23 constitution (August 4,2004, if adjournment sine die is on May 5, 2004);

24 except that, if a referendum petition is filed against this act or an item,

25 section, or part ofthis act within such period, then the act, item, section,

26 or part, if approved by the people, shall take effect on the date of the

27 official declaration of the vote thereon by proclamation of the governor.
