<br />elected by representatives of each public water provider located in the <br />district. Authorizes the district board to regulate and coordinate pumping <br />rates and schedules. Directs the district to pursue the acquisition of <br />long-term renewable surface water resources to use within the district in <br />conjunction with the Denver basin aquifers. <br />Makes a conforming amendment. <br /> <br />I Be it enacted by the General Assembly of the State of Colorado: <br />2 SECTION 1. Article 45 of title 37, Colorado Revised Statutes, <br />3 is amended BY THE ADDITION OF A NEW PART to read: <br /> <br />4 PART 2 <br />5 DENVER BASIN CONSERVANCY DISTRICT <br /> <br />6 <br /> <br />37-45-201. Legislative declaration. (I) THE GENERAL <br /> <br />7 ASSEMBLY HEREBY: <br /> <br />8 (a) FINDS THAT: <br /> <br />9 (I) ECONOMIC CONSIDERATIONS GENERALLY MAKE IT IMPRACTICAL <br /> <br /> <br />10 FOR INDIVIDUAL LANDOWNERS TO DRILL WELLS INTO THE DENVER BASIN <br /> <br />II AQUIFERS FOR INDIVIDUAL WATER SUPPLIES WHERE MUNICIPAL OR <br /> <br /> <br />12 QUASI-MUNICIPAL WATER SERVICE IS AVAILABLE; AND <br /> <br />_____ ____13_________(II)_THE_CUMULATIVEEFFECTS-OF-GON-TINUED-PI:lMPING-BY-BOTH- <br /> <br /> <br />14 INDIVIDUALS AND PUBLIC ENTITIES HAVE LOWERED AQUIFER LEVELS IN <br /> <br /> <br />15 MANY PORTIONS OF THE DENVER BASIN AQUIFERS TO SUCH A DEGREE THAT <br /> <br /> <br />16 IT IS NECESSARY TO PROVIDE FOR THE ACQUISITION OF LONG-TERM <br /> <br /> <br />17 RENEW ABLE SURF ACE WATER RESOURCES TO USE IN CONJUNCTION WITH <br /> <br />18 NONRENEWABLE DENVER BASIN AQUIFERS; <br /> <br />19 <br /> <br />(b) DETERMINES THAT THE PUBLIC INTEREST JUSTIFIES THE <br /> <br />20 AUTHORIZATION OF A DENVER BASIN CONSERVANCY DISTRICT TO <br /> <br />21 PROMOTE SUCH CONJUNCTIVE USE OF SUCH SURF ACE AND GROUND WATER <br /> <br />22 BY WATER SUPPLIERS; AND <br /> <br />-2- <br /> <br />HB04-ll85 <br />
