SECTION 7. 24-33-108 (3), Colorado Revised Statutes, is
amended to read:
24-33-108. Gifts and devises to the department. (3) Any
moneys received as gifts under this section, and any moneys received
from the investment of such moneys or property received under this
section, and any interest tlL(,IC,from FROM SUCH INVESTMENT shall be
credited to a special fund known as the Colorado natural resources
foundation fund. Such fund and any gifts or devises received by the
department of natural resources pursuant to this section shall not diminish
any appropriations made to the department. Such funds shall not be
expended in such a manner as to commit expenditures from the general
fund or any cash fund whic.h THAT is designated for regulatory purposes
within the division of water I('SOU!c.CS ADMINISTRATION. The use of gifts
and devises shall be subject to audit by the state auditor or the auditor's
designee, the cost of which shall be borne by the department.
SECTION 8. 25-8-103 (4) and (7), Colorado Revised Statutes,
are amended to read: -.
25-8-103. Definitions. As used in this article, unless the context.
otherwise requires:
(4) "Division" means the division of lldini:nistillliOll of the
department of pnbli.:. hc.alth and cnmoJl1llcnl WATER RESOURCES
ASSOCIATED WITH THE STATE WA~R QUALIT'(CQ.l'lTR,OLJ;QMMISSION.
(7) "Executive director" means the executive director of the
department of pnbl-ic. health and en v i:I onmcnt WATER RESOURCES.
SECTION 9. 25-8-201 (1) (a), Colorado Revised Statutes, is
amended to read:
25-8-201. Water quality control commission created.
