<br />~ <br /> <br />. <br />, <br /> <br />~ <br /> <br />1 assessment upon indirect dischargers in such publicly owned trea1ment <br />2 works' programs. <br />3 (c) All fees collected pursuant to paragraphs (b) and (b.6) of this <br />4 subsection (1) shall be transmitted to the state treasurer, who shall credit <br />5 the same to the water quality control fund, which fund is hereby created. <br />6 The moneys in such fund that are collected pursuant to paragraph (b) of <br />7 this subsection (1) shall be appropriated annually to the department of <br />8 public llc.alth and cnvllolliu<:ut WATER RESOURCES by the general <br />9 assembly, which shall review expenditures of such moneys to assure that <br />10 they are used only to fund the expenses of the discharge pemlit system. <br />11 All interest earned on the investment ordeposit of moneys in the fund <br />12 and all unencumbered or unappropriated balances in the fund shall remain <br />13 in the fund, shall be appropriated only for the expenses of the discharge <br />14 permit system, and shall not be transferred or revert to the general fund <br />15 or any other fund at the end of any fiscal year or any other time. It is the <br />16 intent of the general assembly that a portion of the expenses of the <br />17 discharge permit system be funded from-the general fund, reflecting the <br />18 benefit derived by the general public; except that the general assembly <br />19 . may determine, in any given fiscal year, that general fund revenues are <br />20 inadequate to meet general fund demands and that, as a consequence, it <br />21 shall be necessary to forego, subject to future recorisideration, all or some <br />22 I!<?~on Qf ~llfl1lle!1~ral~:(tmg f9A.tDlmtiQDJ9 Jh~.disdHlrgegermitprogram <br />23 pursuant to this part 5. <br />24 SECTION 14. 34-32-106 (2), Colorado Revised Statutes, is <br />25 amended to read: <br />26 34-32-106.
