<br />1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br /> <br />e <br /> <br />SHALL CONSULT WITH THE ENTITIES THAT SUPPLY WATER FOR USE WITHIN <br />THE MUNICIPALITY TO ENSURE COORDINATION ON WATER SUPPLY AND <br />FACILITY PLANNING, AND THE WATER SUPPLY ELEMENT SHALL IDENTIFY <br />WATER SUPPLIES AND FACILITIES SUFFICIENT TO MEET THE NEEDS OF THE <br />PUBLIC AND PRIVATE INFRASTRUCTURE REASONABLY ANTICIPATED OR <br />IDENTIFIED IN THE PLANNING PROCESS. 'NOTHING IN THIS PARAGRAPH (b) <br />SHALL BE CONSTRUED TO SUPERSEDE, ABROGATE, OR OTHERWISE IMPAIR <br />THE ALLOCATION OF WATER PURSUANT TO THE STATE CONSTITUTION OR <br />LAWS, THE RIGHT TO BENEFICIALLY US\J WATER PURSUANT TO DECREES, <br />CONTRACTS, OR OTHER WATER USE AGREEMENTS, OR THE OPERATION, <br />MAINTENANCE, REPAIR, REPLACEMENT; OR USE OF ANY WATER FACILITY. <br />SECTION 3. Effective date. (1) This act shall take effect <br />October 1,2003. <br />(2) However, if a referendum petition is filed against this act or <br />an item, section, or part of this act during the 90-day period after final <br />adjournment of the general assembly'that is allowed for submitting a <br />referendum petition pursuant to article V, section I (3) of the state <br />constitution, then the act, item, section, or part, shall not take effect <br />unless approved by the people at a biennial regular general election and <br />shall take effect on the date specified in subsection (1) or on the date of <br />the official declaration of the vote thereon by proclamation of the <br />governor, whichever is later. <br /> <br />e <br /> <br />e <br /> <br />-4- <br /> <br />SB03-094 <br />
