<br />water supply element shall identify water supplies and facilities sufficient <br />to meet the needs of the public and private infrastructure reasonably <br />anticipated or identified in the planning process. Specifies that nothing <br />in the adoption of the water supply: element shall be construed to <br />supersede, abrogate, or otherwise impair the allocation of water pursuant <br />to the state constitution or laws, the, right to beneficially use water <br />pursuant to decrees, contracts, or other water use agreements, or the <br />operation, maintenance, repair, replacement, or use of any water facility. <br /> <br />e <br /> <br />I Be it enacted by the General Assembly of the State of Colorado: <br />2 SECTION 1. 30-28-106 (5); Colorado Revised Statutes, IS <br />3 amended to read: <br /> <br />4 30-28-106. Adoption of master plan - contents. (5) A master <br />5 plan adopted in accordance with the requirements of subsection (4) of this <br />6 section shall contain: <br /> <br />7 <br />8 <br /> <br />(a) A recreational and tourism ~ses element pursuant to which the <br /> <br />county shall indicate how it intends to provide for the recreational and <br /> <br />e <br /> <br />9 tourism needs of residents of the county and visitors to the county <br /> <br />10 through delineated areas dedicated, to, without limitation, hiking, <br /> <br /> <br />I I mountain biking, rock climbing, skii4g, cross country skiing, rafting, <br /> <br />12 fishing, boating, hunting, shooting, or !any other form of sports or other <br /> <br />13 recreational activity, as applicable, and commercial facilities supporting <br /> <br />14 such uses; AND <br /> <br />15 (b) A WATER SUPPLY ELEMENT fURSUANT TO WHICH THE COUNTY <br /> <br />16 SHALL SHOW THE GENERAL LOCATION AND EXTENT OF AN ADEQUATE AND <br /> <br />17 SUITABLE SUPPLY OF WATER. IN CONNECTION WITH THE IMPLEMENTATION <br /> <br /> <br />18 OF THIS ELEMENT IN ACCORDANCE WITH THE REQUIREMENTS OF THIS <br /> <br />19 PARAGRAPH (b), THE PLANNING COMMISSION SHALL CONSULT WITH THE <br /> <br /> <br />20 ENTITIES THAT SUPPLY WATER FOR USIf WITHIN THE COUNTY TO ENSURE <br /> <br />21 <br /> <br />COORDINATION ON WATER SUPPLY AND FACILITY PLANNING, AND THE <br /> <br />e <br /> <br />-2- <br /> <br />SB03-094 <br />
