25-8~803. Project

authorization

(1) Grants and loans to political subdivisions for eligible

projects shall be based on potable water, water quality, and

health-related needs. The commission shall promulgate rules

and regulations establishing a project categorization system

for use in determining the relative priority of eligible

projects. The commission shall review applications for state

funds and shall recommend the department for funding only

those applications which are consistent with the project
categorization system.

(2) The department shall conduct a fiscal analysis of

those political subdivisions recommended for funding by the

commission to determine financial need. Based upon its fiscal

analysis, the department shall determine the percentage of

loan needed to fund wastewater treatment works and the

percentage of contribution or loan needed to fund a potable

water treatment facility and may contract with the applying

political

subdivision accordingly.

The department may

authorize a grant or loan only upon a showing that the

applying political subdivision lacks the fiscal capacity to

fund an eligible project without a state grant or loan. The

.interest rate for any loan made pursuant to this part 8 shall

be five percent simple interest and the pay-bacK period for
