<br />Requires an agency to submit a draft of a proposed rule or <br />amendment to an existing rule to the department of regulatory agencies <br />(department) to determine if the rule may have a negative impact on <br />economic competitiveness or small bl,lsiness in Colorado. Allows the <br />executive director of the department (director) to require the submitting <br />agency to prepare a cost-benefit analysis of the rule or amendment. <br />Requires such agency to make the analysis available to the public and the <br />director. . <br />Allows the director to urge the agency to revise the rule or <br />amendment, if necessary, to eliminate or reduce the negative economic <br />impact. <br />Allows the director to work wit~ the secretary of state to make the <br />code of Colorado regulations and the I=olorado register available to the <br />public in an electronic format. <br /> <br />e <br /> <br />I Be it enacted by the General Assembly of the State of Colorado: <br />2 SECTION 1. 24-4-101.5, Colorado Revi,sed Statutes, is amended <br />3 to read: <br /> <br />4 <br /> <br />24-4-101.5. Legislative declar~tion. The general assembly finds <br /> <br />e <br /> <br />5 that an agency should not regulate or restrict the freedom of any person <br /> <br />6 to conduct his OR HER affairs, use his OR HER property, or deal with others <br /> <br />7 on mutually agreeable terms unless it finds, after a full consideration of <br /> <br />8 the effects of the agency action, that the action would benefit the public <br /> <br /> <br />9 interest and encourage the benefits of a free enterprise system for the <br /> <br />10 citizens of this state. The general assembly also finds that many <br /> <br />II government programs may be adopted without stating the direct and <br /> <br />12 indirect costs to consumers AND BUSINESSES and without consideration <br /> <br />13 of such costs in relation to the benefits to be derived from the programs. <br /> <br /> <br />14 The general assembly furtherrecognizes that agency action taken without <br /> <br />15 evaluation of its economic impact may have unintended effects, which <br /> <br /> <br />16 may include barriers to competition, reduced economic efficiency, <br /> <br />17 <br /> <br />reduced consumer choice, increased producer and consumer costs, and <br /> <br />e <br /> <br />-2- <br /> <br />SB03-121 <br />
