<br />1 SECTION 1. 37-95-107.5 (3), Colorado Revised Statutes, is <br /> <br /> <br />2 amended to read: <br /> <br /> <br />3 37-95-107.5. Legislative declaration - specific project <br /> <br /> <br />4 authorizations. (3) Several compacts relating to interstate streams have <br /> <br />5 been entered into by the state on behalf of the people of the state of <br /> <br /> <br />6 Colorado to reserve for the people the right to the use of such waters <br /> <br /> <br />7 under the appropriation doctrine. It is hereby declared to be the policy of <br /> <br /> <br />8 the general assembly to fully utilize, for the maximum benefit of all the <br /> <br /> <br />9 people, said natural stream resources. To achieve such utilization, the <br /> <br /> <br />10 general assembly hereby directs the authority to proceed with project <br /> <br /> <br />11 development and financing, in accordance with agreements between the <br /> <br />12 project sponsor and the authority and consistent with the provisions of <br /> <br /> <br />I3 this article, FOR such projects as the Colorado water conservation board <br /> <br /> <br />14 identifies in statewide water supply initiatives and associated feasibility <br /> <br />15 studies and other projects identified by the authority, GIVING HIGH <br /> <br /> <br />16 PRIORITY TO PROJECTS INVOLVING THE DREDGING OR REPAIR, INCLUDING <br /> <br /> <br />17 REPAIRS FOR SAFETY PURPOSES, OF EXISTING RESERVOIRS. <br /> <br /> <br />18 _ SECTION 2._EtJ~cJiy~.dl!te._Thi_uctshaILtake_effectaU2:0 1 <br /> <br /> <br />19 a.m. on the day following the expiration of the ninety-day period after <br /> <br /> <br />20 final adjournment of the general assembly that is allowed for submitting <br /> <br /> <br />21 a referendum petition pursuant to article V, section I (3) of the state <br /> <br />22 constitution (August 4,2004, ifadjournment sine die is on May 5, 2004); <br /> <br /> <br />23 except that, if a referendum petition is filed against this act or an item, <br /> <br /> <br />24 section, or part of this act within such period, then the act, item, section, <br /> <br />25 or part, if approved by the people, shall take effect on the date of the <br /> <br /> <br />26 official declaration of the vote thereon by proclamation of the governor. <br /> <br />-2- <br /> <br />1243 <br />
