1 SECTION 1. 37-95-107.5 (3), Colorado Revised Statutes, is

2 amended to read:

3 37-95-107.5. Legislative declaration - specific project

4 authorizations. (3) Several compacts relating to interstate streams have

5 been entered into by the state on behalf of the people of the state of

6 Colorado to reserve for the people the right to the use of such waters

7 under the appropriation doctrine. It is hereby declared to be the policy of

8 the general assembly to fully utilize, for the maximum benefit of all the

9 people, said natural stream resources. To achieve such utilization, the

10 general assembly hereby directs the authority to proceed with project

11 development and financing, in accordance with agreements between the

12 project sponsor and the authority and consistent with the provisions of

I3 this article, FOR such projects as the Colorado water conservation board

14 identifies in statewide water supply initiatives and associated feasibility

15 studies and other projects identified by the authority, GIVING HIGH

16 PRIORITY TO PROJECTS INVOLVING THE DREDGING OR REPAIR, INCLUDING

17 REPAIRS FOR SAFETY PURPOSES, OF EXISTING RESERVOIRS.

19 a.m. on the day following the expiration of the ninety-day period after

20 final adjournment of the general assembly that is allowed for submitting

21 a referendum petition pursuant to article V, section I (3) of the state

22 constitution (August 4,2004, ifadjournment sine die is on May 5, 2004);

23 except that, if a referendum petition is filed against this act or an item,

24 section, or part of this act within such period, then the act, item, section,

25 or part, if approved by the people, shall take effect on the date of the

26 official declaration of the vote thereon by proclamation of the governor.
