Atachment B-1 <br /> RESOLUTION OF THE SUMMITVILLE <br /> NATURAL RESOURCES TRUSTEES <br /> WHEREAS, a Memorandum of Understanding(MOU)between the Federal and State <br /> Natural Resources Trustees (Trustees)was duly signed, executed, and became effective <br /> June 19, 2002; and <br /> WHEREAS, the MOU by its terms, specifically paragraph XII.G, expires on December <br /> 31, 2006, but may be extended an additional five years by written agreement of all <br /> Trustees; and <br /> WHEREAS,the Trustees desire to extend the MOU an additional five years to continue <br /> the cooperation,oversight,and project recommendation,selection, and implementation <br /> activities that are occurring among the Trustees,the Trustees' Council and the local <br /> community; and <br /> WHEREAS, sections IX and X of said MOU provide for the expenditure of funds from <br /> the Federal Summitville Restoration Account, which resides with the Restoration Fund <br /> Manager, Department of the Interior, and the State Summitville NRD Trust Fund, for the <br /> funding of specific projects to restore, replace, or acquire the equivalent of natural <br /> resources damaged by hazardous substance releases from the Summitville Mine; <br /> WHEREAS,the Alamosa River Watershed Master Restoration Plan(Master Plan)has <br /> been developed under the supervision of and in cooperation with the Trustees' Council <br /> and has been approved by the undersigned Trustees in accordance with paragraph <br /> VIII(A)of the MOU; <br /> WHEREAS,the Master Plan has identified three"tiers"of restoration projects; <br /> WHEREAS,the Trustees' Council has diligently developed the Solicitation for Proposals <br /> for Phase I of the project implementation contemplated in the Master Plan and has <br /> received and evaluated three such proposals within the last year; and <br /> WHEREAS,the Trustees' Council and the"Working Group"established by the Council <br /> to evaluate proposals for Phase I to implement restoration projects selected in the Master <br /> Plan,have unanimously recommended that the Trustees approve funding for three Phase <br /> I projects identified in Tiers 1 and 2 of the Master Plan, for an amount totaling <br /> $2,354,325; and <br /> WHEREAS,the three projects identified above are captioned as the"Alamosa River In <br /> Stream Flow"project, the"Alamosa River Watershed Restoration"project, and the <br /> "Public Land Alamosa River Watershed Restoration"project, and as they are more <br /> particularly described in Appendix A attached hereto; and <br />
