<br /> ation of Other Good and Valuable Considerations and TEN AND NO/100 DOLLARS
<br /> ($10.00) , in hand paid, hereby sells and quit claims to the COLORADO WATER
<br /> CONSERVATION BOARD, DEPARTMENT OF NATURAL RESOURCES, STATE OF COLORADO, whose
<br /> address is 1313 Sherman Street, Denver, Colorado, 80203, County of Denver, and
<br /> State of Colorado, the following real property, in the County of Fremont, and
<br /> State of Colorado, to-wit:
<br /> 300 feet of ditch lining (three-foot width and three-foot
<br /> depth) immediately upsteam of the parshall flume at ditch
<br /> station 0+00 on the east edge of Section 28, Township 18
<br /> South, Range 63 West, 6th Principal Meridian; and,
<br /> 10,500 feet of ditch lining (three-foot width and three-foot
<br /> depth) of the Upper Ditch beginning at station 114+00 in the
<br /> center of Section 29, Township 18 South, Range 68 West, 6th
<br /> Principal Meridian, and continuing to Brush Hollow Reservoir
<br /> Gel? in the NW corner of Section 30, Township 18 South, Range 68 West,
<br /> 6th Principal Meridian; and,
<br /> A 12-inch PVC pipe with all appurtenances of the Kelley lateral
<br /> beginning at the Upper Ditch on the east edge of Section 28 and
<br /> continuing south for 4,550 feet to the Lower Ditch at the east
<br /> edge of Section 33, Township 18 South, Range 68 West, 6th
<br /> Principal Meridian; and,
<br /> 2,000 feet of ditch lining (two-foot width .and two-and--a-half-foot
<br /> depth) of the Beaver Park Lower Canal, beginning in the SE1 of NE1
<br /> of Section 31, Township 18 South, Range 68 West, 6th. Principal
<br /> Meridian, and ending at about the east boundary of Section 31,
<br /> Township 18 South, Range 68 West, 6th Principal Meridian;
<br /> with all its appurtenances,
<br /> This Deed is made in accordance with that certain Contract heretofore
<br /> entered into on the 1st day of September, 1981, by and between the State of
<br /> Colorado for the use and benefit of the Department of Natural Resources (Colorado
<br /> Water Conservation Board) and Beaver Park Water, Inc. , and in accordance with
<br /> Colorado Revised Statutes, 1973, 37-60-120; PROVIDED HOWEVER, that upon repayment
<br /> of funds as called for in the Contract dated September 1, 1981, as the same were
<br /> made available by Colorado Revised Statutes, 1973, 37-60-119, the State of Colorado
<br /> shall reconvey said property to the Grantor herein.
