<br /> THIRD CONTRACT AMENDMENT
<br /> THIS CONTRACT, made this 1st day of June 198 6 , by and between the
<br /> State of Colorado for the use and benefit of the Department of '1 Natural Resources
<br /> (Colorado Water Conservation Board) , __
<br /> hereinafter referred to as the State, and '2 the Town of Parachute,
<br /> P. CL—Box 217, Parachute, CO 81635_,
<br /> hereinafter referred to as the contractor,
<br /> WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
<br /> available and a sufficient unencumbered balance thereof remains available for payment in Fund Number_4008
<br /> G/L Account Number 5762X , Contract Encumbrance Number C153314 and
<br /> ABL Account Number 17621, Org. Unit 77-77-777,
<br /> WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
<br /> agencies; and
<br /> WHEREAS, the State and the Contractor did on September 1,
<br /> 1979, enter into a contract for State participation in the
<br /> construction of the Parachute project; and
<br /> WHEREAS, the contract was amended on February 15 , 1982, and
<br /> on June 1, 1984; and
<br /> WHEREAS, the Town of Parachute in a letter to the State
<br /> requested that their yearly payment be made during the month of
<br /> May from 1986 onwards; and
<br /> WHEREAS, the State approved such request in January, 1986 .
<br /> NOW, THEREFORE, in consideration of the mutual and
<br /> dependent covenants hereby contained, it is agreed by the
<br /> parties hereto as follows :
<br /> 1. The terms and provisions of paragraph A. 9 . of that certain
<br /> contract dated September 1, 1979 (Exhibit A) , and as amended on
<br /> February 15, 1982 (Exhibit B) , and as further amended on June
<br /> 1, 1984 (Exhibit C) , which exhibits A, B, andve ae attached
<br /> hereto and incorporated herein by reference, 1 n o er be
<br /> effective and are further amended to read as of s
<br /> A. 9 . To purchase from the Sta of the State ' s
<br /> right, title, and interest in said p o

<br /> Hundred Thirty-Seven Thousand Three Hundred e 1.4
<br /> Dollars and Forty Cents ($437, 329 . 40) , payable in the
<br /> following manner :
<br /> First Year $ 10, 815 .00
<br /> Second Year 4,000 .00
<br /> Third to Fortieth Year 11, 118 . 80
<br /> $437, 329 . 40
<br /> The first, second, and third installments shall be due and
<br /> payable on February 1, 1983 , and yearly thereafter through
<br /> the year 1985 . All other installments shall be due and
<br /> payable on May 1, commencing in the year 1986 and yearly
<br /> thereafter until the entire principal sum shall have been
<br /> paid . Said installment payments shall be made payable to
<br /> the Colorado Water Conservation Board, payable at the
<br /> offices of said board in Denver , Colorado .
<br /> 2 . All other terms and provisions of that certain contract
<br /> dated September 1, 1979, attached hereto as Exhibit A, and
<br /> those certain contract amendments dated February 15, 1982
<br /> (Exhibit B) , and June 1, 1984 (Exhibit C) , shall remain in full
<br /> force and effect.
