I I CONTRACT AMENDMENT
THIS CONTRACT, made this 15th day of February 1982, by and between the
State of Colorado for the use and benefit of the Department of '' Natural Resources
(Colorado Water Conservation Board) .
hereinafter referred to as the State, and '2 the Town of Parachute (nee Grand Va 1 1 ey) ,
P. O. Box 217, Parachute, Colorado 81635,
hereinafter referred to as the contractor,
WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008
G/L Account Number 5762X, Contract Encumbrance NumberC 15 3 314 ; and
WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
agencies; and
WHEREAS , the State and the Contractor did on September 1 ,
1979, enter into a contract for State participation in the
construction of the Parachute (Grand Valley) project for the
benefit of the inhabitants of the Town of Parachute in Garfield
County , Colorado , which contract is attached hereto as Exhibit A
and hereby incorporated herein ; and
WHEREAS, the project originally conceived had to be modified
due to the rapid population growth ;
NOW, THEREFORE , in consideration of the mutual and dependent
covenants herein contained, it is agreed by the parties hereto as
follows :
1 . The terms and provisions of paragraphs A. 2 . , A.9 . and
B.4. of that certain contract dated September 1 , 1979, attached
hereto as Exhibit A and incorporated herein by reference shall no
longer be effective but shall be amended to read as follows :
A.2. Convey or cause title to be conveyed by warranty deed
to the Colorado Water Conservation Board , Department of Natural
Resources, State of Colorado, the following portion of the
proposed project facility :
( a) One hundred and sixteen ( 116 ) 3/4-inch water meters
installed throughout the Town of Parachute .
(b) A 12-inch , 3000 + feet of AC transmission main ,
with valves and all appurtenances from the water storage
tanks towards the water treatment plant ; i .e . ,
Sta . (0+00) to Second Street and continued in Second
Street to Railroad Avenue, then South in Railroad Avenue
under the existing highway and the future I -70 , under
the railroad tracks to County Road 300, then continuing
Southeast in County Road 300 to Sta . ( 30+00 ) .
( c) A 10-inch , 1874 + feet of AC transmission main ,
with valves and appurtenances from Sta . ( 30+00) in ( b )
continuing Southeast in County Road 30(x;'. tQ �heM water

(d) A 12-inch , 2122 + feet of AC-_.transmission main ,
with valves and all appurtenances .f (am` they intersect ion

Railroad Avenue to Fourth Street , then West in FOurth
Street to Parachute Avenue , then South in Parachute
Avenue to Sta . ( 21 +22 . 13) , just South of Third Street .
All mains described in (b) (c) and (d ) above are as shown in
Appendices A and B .
