CONTRACT
THIS CONTRACT, made this .. , day of ji,r� 198 L . by and between the
State of Colorado for the use and benefit of the Department of '' Natural Resources
(Colorado Water Conservation Board) ,
hereinafter referred to as the State, and •2 the Blue River Water District
P. 0. Box 2479 , Breckenridge, CO 80424 ,
hereinafter referred to as the contractor /Contractor.
WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008
G/L Account Number 535 3X, Contract Encumbrance NumberC 15 3 351 : and
ABL Account No. 13530 , Org. Unit 77-77-777 ,
WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
agencies: and
WHEREAS, a contract was entered into on July 15 , 1981,
between the State and the Contractor (hereinafter the "original
contract" ) for the Blue River Water District project; and
WHEREAS, the State desires to extend the time of completion
of the project ; and
WHEREAS, paragraph A. 2. of the original colittatt 'proVides
for extension of time if such time is insu.fftci•ent because of
circumstances beyond the control of the Contractor and
WHEREAS, the Contractor could not complete the seondphase
of the project because of lack of matching funds ; and
WHEREAS, the Contractor is now ready to proceed with the
second phase of this project; and
WHEREAS, the Contractor has proceeded on his own and
designed the second phase of this project with his own moneys;
and
WHEREAS, the State has approved the submitted contract
documents; and
WHEREAS, the Contractor has sufficient matching funds to
match the State moneys .
NOW THEREFORE, it is hereby agreed that :
1 . This contract amendment is supplemental to the original
contract (Exhibit A) , which is by this reference incorporated
and made part hereof . All terms , conditions , and provisions of
the original contract unless specificallyamended herein shall
remain in full force and effect .
2 . The original contract shall be amended as follows :
a . In paragraph A. 2 . , third line, strike "two (2) " and
insert in lieu thereof "ten (10) " .
b. In paragraph A. 5 . , insert nine new paragraphs which
will read as follows :
g. One adsorption clarifier 88 to 263 gal . /min.
capacity, CPC Micro Floc, model AC-17 .
h. One Hach turbidimeter, model 1720C.
i . One Hach-Chessell recorder, model 300.
