<br /> (Colorado Water Conservation Board) ,
<br /> hereinafter referred to as the State. and the Fruitland Mesa Water Conservancy
<br /> __District, Route 1, Crawford, CO 81415 ,
<br /> hereinafter referred to as the contractor.

<br /> WHEREAS. required apprusal, clear nee and coordination has been accomplished from and with appropriate
<br /> aeencieh; and
<br /> WHEREAS , pursuant to the provisions of section 37-60-119 ,
<br /> Colorado Revised Statutes , as amended , the State is authorized
<br /> to construct certain water projects for the benefit of the
<br /> people of the State of Colorado ; and
<br /> WHEREAS , the Contractor has made application to the State
<br /> for the improvement of its existing facility, such improvement
<br /> of the facility is hereinafter sometimes referred to as the
<br /> project ; and
<br /> WHEREAS , the Contractor is a Water Conservancy District
<br /> within the State of Colorado ;
<br /> NOW THEREFORE, it is hereby agreed that :
<br /> 1 . The Contractor shall have a feasibility report prepared
<br /> and directed to the problem of repairing its facility in
<br /> accordance with a proposal for a project feasibility report
<br /> prepared by the consulting engineering of Ute Engineering
<br /> and Surveying Company ( the Consultant) '. p 'o 'e by the
<br /> State , received October 9 , 1986 , whicht.Y4o ,a °attached
<br /> hereto as Exhibit A and made a part of this doi4t1t•a. . .
<br /> 2 . Fifteen ( 15 ) copies of the ?f ± 40 c , 1 for in
<br /> this contract shall be furnished to-th`e SXat `not' lad;, r than
<br /> April 1, 1987 , unless such time is extended bp,.°inu ,. ;',,.agreement
<br /> of the parties hereto in writing .
<br /> 3 . As compensation for the services of the Contractor , the
<br /> State shall pay to the Contractor the sum of Three Thousand
<br /> Dollars ($3 , 000 ) in the manner following :
<br /> a . Sixty percent ( 60% ) , to wit, One Thousand Eight Hundred
<br /> Dollars ($1, 800) of the total amount Sue in two (2 ) monthly
<br /> installments of Nine Hundred Dollars ($900) each,
<br /> commencing on November 15 , 1986 .
<br /> b . The remaining forty percent (40%) , to wit , One Thousand
<br /> Two Hundred Dollars ($1, 200) within forty ( 40) days
<br /> following receipt and acceptance of the written report
<br /> specified in paragraph 2 . of this contract .
<br /> 4 . The total cost of services to be rendered for the
<br /> Contractor by the Consultant is Six Thousand Dollars ($6 , 000)
<br /> and the Contractor shall pay the sum of Three Thousand Dollars
<br /> ($3 , 000) as agreed to by letter dated September 24 , 1986 , which
<br /> is hereby attached and made a part of this contract as Exhibit
<br /> B; and in no event shall this payment be the liability of the
<br /> State of Colorado .
