binding against the BORROWER if entered into by the CWCB.
5. The BORROWER agrees that it shall provide the following documents, all of which shall
set forth the loan amount of$2,443,000:
a. Promissory Note, attached as Attachment A and incorporated herein, which shall
replace and supersede the Promissory Note in the amount of $2,081,000 dated
March 1, 2002, attached to the ORIGINAL CONTRACT as Appendix 2.
b. Ordinance, attached hereto as Attachment B and incorporated herein, adopted by
the BORROWER'S governing body, irrepealable for the term of this loan, authorizing
the BORROWER to enter into this contract amendment to borrow the additional
$362,000 and to make and levy assessments sufficient to pay the annual loan
payments.
c. Amended Security Agreement, attached hereto as Aka��"`A ,a ! incorporated
herein, which shall supplement and operate in conjunction with the Security
Agreement dated March 1, 2002, attached to tlMNA & as pendix 4.

6. The parties agree that the ORIGINAL CONTRACT, is and shall be modified, altered, and
changed in the following respects only:
a. Project Summary, Section 3 — Board Approval and Legislative Authorization, shall be
revised by the addition of the following:
At its July 2001 meeting, the CWCB approved increasing this loan by $362,000 for a
total loan amount of $2,443,000. The terms for the additional loan amount are an
interest rate of 5.50% per annum and a repayment term of 30 years. The CWCB
has authority to increase the loan amount pursuant to SB01-157 Section (2)(2).
7. Except for the SPECIAL PROVISIONS, in the event of any conflict, inconsistency, variance,
or contradiction between the provisions of this Amendment and any of the provisions of
the ORIGINAL CONTRACT, the provisions of this Amendment shall in all respects
supersede, govern, and control. The SPECIAL PROVISIONS shall always be controlling
over other provisions in the contract or amendments. The representations in the
SPECIAL PROVISIONS concerning the absence of bribery or corrupt influences and
personal interest of STATE employees are presently reaffirmed.
