Loan Compliance Confirmation
Dear Mr. Morley:
Attached for your records are the original documents relative to the agreement between the
Excelsior Irrigating Company (Company) and the Colorado Water Conservation Board (CWCB), Loan
Contract No. C153797, dated February 11, 1998, as amended. The documents have been stamped "PAID
IN FULL"denoting that the terms of the agreement have been satisfied in full by the Company.
Also attached are the following documents:
1. The original Promissory Note stamped "PAID IN FULL" and "CANCELLED AND
RELEASED PUEBLO COUNTY PUBLIC TRUSTEE;"
2. Three Requests for Full Release of Deed of Trust and Release and the recorded Deeds of
Trust;
3. The Request for Partial Release of Deed of Trust and Partial Release and supporting
documents;
4. The UCC Financing Statement Amendment terminating the filing of the Security
Agreement;
5. Previously filed and expired UCC's; and
6. Miscellaneous correspondence.
Please note that an "Assignment of Deposit Account as Security" included as Attachment 7 to
Amendment No. 1 of this agreement, provided that a Deposit Account would be established at Substantial
Completion of the construction of this project. The Company did not execute these terms and therefore a
release for an account will not be necessary.
