Advance payment of anticipated OM&R costs will be required of any entity participating <br /> the Tamarack Plan with the exception of the State of Colorado. The CWCB will, after <br /> .consultation with participating entities, establish the advance payments based on historic <br /> and projected costs and anticipated pumping as defined in the AOP. Advance payments <br /> will be due on or before the finalization of the AOP but not later than November 1 of <br /> each year. Tamarack Plan facilities will not be operated at any time for the benefit of any <br /> non-State of Colorado entity unless the funds in that entity's operating fund account <br /> exceeds a pre-determine balance. <br /> Accounting performed by the CWCB will be subject to review by GASP, LSPWCD, <br /> NCWCD, and any other entities which are contributing to the operational costs of the <br /> Tamarack Plan facilities. <br /> The CWCB, or its designee, will administer all funds associated with the Tamarack Plan, <br /> including both the Water Administration Account Fund and the Recovery Program <br /> Account Fund, as applicable. <br /> Funds in these accounts shall be invested in interest-bearing accounts in accordance with <br /> applicable State of Colorado rules, regulations, poii.;ies, and proc:dure . <br /> h. Facilities Operation and Maintenance <br /> The CWCB will be the entity responsible for the actual operation and maintenance of the <br /> facilities associated with the Tamarack Plan. CWCB may, at its discretion, contract for <br /> the operation and maintenance of these facilities. If such a contract is awarded, preference <br /> for awarding a contract shall be given to non-profit entities such as LSPWCD., GASP, or <br /> NCWCD which have a vested interest in the continuing satisfactory operation of the <br /> Tamarack Plan. <br /> 9 <br />
