the use of existing or future reservoirs and canals for these same purposes. The integration of <br /> water contributions from all of the facilities to meet the Tamarack Plan commitment is an <br /> important task that remains to be completed. <br /> a. Acquisition of Lands <br /> Lands, or interests in lands, required for these facilities would be acquired by the State of <br /> Colorado and paid for with state funds. It is assumed that most of the new water facilities <br /> to be added to the Tamarack Plan will be located on property that was previously <br /> privately-owned but for which the State of Colorado has obtained a property interest (fee, <br /> long-term lease, or easement). The interest acquired by the State could be fee, long-term <br /> lease, or an easement. The legal interest in these lands would be held by either the <br /> Department of Natural Resources (DNR) or the Colorado Water Conservation Board <br /> (CWCB). State funding for the acquisition of the lands would come from funds <br /> appropriated from either the Species Conservation Fund created by HB 98-1006, or from <br /> other appropriations to the Department of Natural Resources. Acquisition and other costs <br /> associated with these lands would be attributed to the State's obligation under the Three- <br /> State Cooperative Agreement and the subsequent associated Recovery Program. <br /> Managed groundwater recharge will most likely produce water related benefits for uses <br /> other than the Program. If the assets acquired or developed for the Tamarack Plan are <br /> used for, or result in benefits for other purposes such as, but not limited to, the <br /> preservation, propagation, or enhancement of species of concern, an appropriate share of <br /> the costs should be allocated to and paid by other agencies or interests. However, it is <br /> important that ownership and control of the Tamarack Plan facilities remain with DNR or <br /> CWCB to provide a level of certainty in the State's ability to deliver water for the <br /> Program at known cost. <br /> Some of these principles will have to be modified to the extent that parts of the <br /> Tamarack Plan are implemented on properties that are currently state-owned lands such <br /> as the Tamarack State Wildlife Area(TSWA), Pony Express State Wildlife Area <br /> (PESWA), or lands owned by the Colorado State Land Board. These types of <br /> development will have to balance the state's interests and uses for these properties with <br /> the need to develop water for the Programa. <br /> b. Design of Facilities <br /> The CWCB would be responsible for the design of the Tamarack Plan facilities, through <br /> the use of CWCB staff or by contract with an outside consultant or entity. The design of <br /> the facilities would be reviewed in advance by the Groundwater Appropriators of the <br /> South Platte (GASP), the Lower South Platte Water Conservancy District (LSPWCD), <br /> a See Appendix 3 for discussion of land use arrangements. <br /> 5 <br />
