Measure 2: Examples of a material change in circumstances <br /> include, but are not limited to, a change in the operating procedures <br /> by which previously stored water is released from Green Mountain <br /> Reservoir under the 1984 Operating Policy and the terms of the <br /> Orchard Mesa Check Decree, Case No. 91CW247, Water Division <br /> 5. <br /> 3. Measure 3: Examples of a material change in circumstances <br /> include, but are not limited to, a reduction, elimination, or other <br /> significant change from historical practice in the operation of the <br /> administrative call of the Shoshone Power Right, except as <br /> expressly set forth in paragraph of the <br /> agreement between Xcel Energy and the Denver Water Board <br /> dated . Another example is an abandonment, material <br /> reduction, or change in the manner of operation of the Cameo <br /> group of water rights. <br /> 4. Measure 4: As discussed above, the SG expects a change in the <br /> methods by which the water users' obligation of water delivered to <br /> the endangered fish in the 15-Mile Reach within the next years. <br /> The SG will not assert a material change in Measure 4 if the <br /> anticipated change is limited to no more than_% of the existing <br /> average annual deliveries of water to the endangered fish species <br /> from points upstream of Kremmling. <br /> B. Any active member of the SG may assert a Changed Circumstance in the <br /> implementation of one of the Long Term Protective Measures by <br /> submitting a written request for the SG to convene a meeting (or add an <br /> agenda item to a previously set meeting) pursuant to the procedures for <br /> elevation in Section IV.d of the Implementation Outline. The SG will <br /> determine by consensus whether a material change in circumstances <br /> exists and, if so, how to address the change by cooperative measures. <br /> C. If, in accordance with the SG's adopted Governance Protocol, the SG <br /> agrees that a material change in circumstances exists, but does not agree <br /> how to address by cooperative measures any material change that the SG <br /> does agree exists, then the SG agrees to proceed to elevate this matter to <br /> BLM in accordance with Section IV.e of the Implementation Outline. <br /> Page 4 of 4 <br />
