BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AURORA, <br /> COLORADO, ACTING BY AND THROUGH THE CITY OF AURORA, COLORADO <br /> UTILITY ENTERPRISE: <br /> ARTICLE ONE <br /> DEFINITIONS AND CONSTRUCTION <br /> Section 1.01. Definitions. In this Ordinance the following terms have the following <br /> respective meanings unless the context clearly requires otherwise: <br /> Acquire or Acquisition: the design, construction, reconstruction, <br /> purchase, lease, gift, transfer, assignment, option to purchase, grant from the federal <br /> government or any public body or other person, endowment, bequest, devise, installation, <br /> condemnation, contract, or other acquirement or other provision, or any combination <br /> thereof, of facilities, other property, any project,or an interest therein. <br /> Additional First-Lien Revenue Obligations: any First-Lien Revenue <br /> Obligations issued after the issuance of the first Series of First-Lien Revenue Obligations <br /> authorized by this Ordinance. <br /> Average Annual Debt Service Requirements: with respect to any one or <br /> more Series of Obligations with respect to which the calculation is being made, the <br /> aggregate Debt Service Requirements thereof divided by the number of whole or <br /> fractional years from the date as of which the calculation is made to and including the <br /> final maturity thereof. <br /> • <br /> Bond Anticipation Note: an Obligation issued in anticipation of the <br /> receipt of proceeds of Bonds or other Obligations and maturing within five(5) years. <br /> Bonds: all securities issued in the• form of bonds pursuant to the <br /> provisions of this Ordinance which are payable from and secured by a lien upon the Net <br /> Pledged Revenues.• <br /> Business Day: a day on which the offices of the City or banks or trust <br /> companies in Denver, Colorado are not authorized or required to remain closed and on <br /> which the New York Stock Exchange is not closed. <br /> Capital Lease: a lease which is required or permitted to be capitalized for <br /> financial reporting purposes under Generally Accepted Accounting Principles for <br /> governmental units or enterprises. <br /> • <br /> Capital Project: any additions or Improvements to the System determined <br /> by the Council, which additions and Improvements may be more specifically identified <br /> by Series Ordinance, Supplemental Resolution or Final Terms Certificate. <br /> Charter: the Home Rule Charter of the City. <br /> #866939v11 2 <br />
