Water Project Loan Program, Finance Section Colorado Water Conservation Board 1313 Sherman St, Room 718 Denver, CO 80203 re: Request for Extension; Loan Contract#C150364 for HCWCD's regional augmentation plan Dear Anna, Please accept this request for an extension under the above contract to June 12, 2019. As it stands now,the loan contract(p. 11, and p. 4 of Appendix 1)provides that project completion will be within three years of the contract's effective date or January 9, 2017. As described below,the District has encountered unforeseen delays necessitating an extension. This is submitted contemporaneously with a similar request regarding the related Grant Agreement#C150551 for the Red Wing Augmentation Facility. Thanks to the loan,the District purchased the needed senior water right(along with the Camp Ranch itself)and built and operated the augmentation facilities needed on the ranch. As a result,with the addition of mil levy income,we have received SEO approval of annual SWSPs operations through 2016 and have continued to supply augmentation water to the Town of Gardner(including the school),many rural residents by use of the fill station for their cisterns, several out of compliance subdivisions,the Huerfano County board of Commissioners and several other users. Along the way, we completed a Phase I environmental site assessment, obtained the appropriate Huerfano County HB 1041 permit and a USACE Nationwide §404 Permit Verification, and contracted for the engineering design and construction supervision of RWAF (completion of that contract awaits issuance of a water court decree). Of the$2,222,000 principal amount of the loan, $249,134 remains to be drawn. In December,2013,the District applied for Water Court approval of a permanent regional augmentation plan in Case No. 13CW3062, Water Division 2. There were ten statements of opposition to the application of which all but two have been resolved by stipulation. Of those two (1)we have reached a hand-shake deal with the SEO, CWCB, and DEO and expect to execute a written stipulation before the end of this month and(2) have yet to resolve the opposition of a neighboring water rights owner, Lucy Hibberd, although we are continuing to make efforts to do so.
