Facility Name: Colorado Native Aquatic Species (BUYING AGENCY#) <br /> Restoration Facility <br /> Performance Period: R- 1 to f oZ'3 I( 20D i ROUTING NO. dV � p` 0 O0 I6 <br /> Fiscal Year Can -O k CONTRACT NO.C150028 <br /> Amount: $2,000,000 <br /> MEMORANDUM OF UNDERSTANDING <br /> BETWEEN <br /> THE COLORADO WATER CONSERVATION BOARD <br /> AND <br /> • <br /> THE COLORADO DIVISION OF WILDLIFE <br /> WHEREAS, authority exists in the law and funds have been budgeted, appropriated and otherwise made <br /> available and a sufficient unencumbered balance thereof remains available for payment in <br /> COLORADO WATER CONSERVATION BOARD, FUND NUMBER 424, AGENCY PDA, <br /> ORGANIZATION YYYY,APPROPRIATION CODE FWA,PROGRAM WTRC,FUNCTION <br /> OBJECT CODE 5140, GBL NASF, REPORTING CATEGORY 0028,FACILITY NUMBER <br /> $2,000,000.00,CONTRACT ENCUMBRANCE NUMBER 150028; and <br /> WHEREAS, the Colorado Water Conservation Board ("CWCB") and the Colorado Division of Wildlife <br /> ("CDOW")are responsible for protection of the fishery and water resources of the State of Colorado; and <br /> WHEREAS, the CWCB and the CDOW have determined that the development and maintenance of a <br /> facility providing for the protection and culture of aquatic species identified as rare, threatened or <br /> endangered on a statewide basis would aid in efforts to protect and enhance populations of these species <br /> considered to be in decline, assist in the management and balance between native and non-native species, <br /> and allow future development of the State's compact apportioned water resources to continue;and <br /> WHEREAS, on September 13, 1993, the Colorado Wildlife Commission ("CWC") and the CWCB <br /> approved a joint resolution regarding the development and maintenance of a Native Aquatic Species <br /> Facility; and <br /> WHEREAS, in November 1996, the CWC and the CWCB approved a joint funding resolution for the <br /> construction and operation of a Native Aquatic Species Facility("the Facility"); and <br /> WHEREAS, at its January 1997 meeting, the CWCB approved a grant to the CDOW of up to $2,000,000 <br /> for the Facility on the condition that the CDOW submit a detailed proposal concerning the Facility that <br /> includes cost-sharing arrangements for both capital and operating costs, and provide the CWCB an <br /> opportunity to review all appraisals of property considered for Facility use; and <br /> WHEREAS, pursuant to 1997 Colo. Sess. Laws, Ch. 168, Section 11(1), the General Assembly authorized <br /> the CWCB to make a grant of not more than two million dollars from the Fish and Wildlife Resources <br /> Account of the CWCB Construction Fund to the CDOW for the development and initial operation of the <br /> Facility,with said grant not to exceed forty percent of the actual cost to develop and operate the Facility for <br /> the first three years of operation; and <br /> Page 1 of 5 <br />
