year loan). Collateral for this loan is a conveyance of an individual 1/10 interest in
Prospect Reservoir. The second is a 1981 loan for $260,000 for the purpose of
repair of damages to the Horse Creek Reservoir Dam, with a remaining principal
amount of $164,220 and an annual payment of $15,153 through 2022 (40-year loan).
Collateral for this loan is a conveyance of an undivided 1/2 interest in the Horse Creek
Reservoir. Also, Borrower also has an interest-free $1,000,000 loan with the U.S.
Bureau of Reclamation for the purpose of concrete lining its ditch laterals and canals,
with a remaining principal amount of $79,288 and an annual payment of $32,800
through 2008. In addition, Borrower has a $75,861 loan with CNH Capital for
purchase of an excavator, with a remaining principal amount of $44,115 and an
annual payment of $20,513 through 2009. Collateral for this loan is the excavator
itself. The last two loans will be retired prior to the s f CWCB loan repayment
(2010).
SECTION 6-COLLATERAL
The collateral provided for this loan, as eviden e Trust, in
the form attached as Appendix 5 and Appendix a d in, shall be
a 10% interest in Horse Creek Reservoir and a 10% interest in servoir, as
more particularly described in the attached Deeds of Trust ("Collateral" .

SECTION 8—CONSTRUCTION FUND PROGRAM PROCEDURES
A. The BORROWER shall employ an engineer, registered in the state of Colorado to
prepare plans and specifications for the PROJECT.
B. The BORROWER'S and the Engineering Consultant's Agreements and the plans and
specifications must be submitted to the CWCB staff for verification of compliance
with the terms of this Contract when available prior to bidding. Any modifications to
the plans and specifications must be approved in writing by the CWCB staff.
C. For plans and specifications for all jurisdictional dams and reservoirs, as defined by
§ 37-87-105 C.R.S., the BORROWER shall provide a letter of approval from the State
Engineer's Office prior to construction.
D. CWCB staff must be present at bid opening Ind must approve the award of the
construction contract.
E. The BORROWER shall contract for the construction of the work with responsible and
capable Construction Firms, which said Construction Firms shall be selected by the
BORROWER and found acceptable by the CWCB staff.
F. The BORROWER must provide a copy of the executed construction contract
documents consisting of the contractor's proposal, construction contract,
performance bond, payment bond, notice of award, notice to proceed, sample
change order, and sample field order, as well as the advertisement for bid and bid
bond at bidding. After the CWCB staff verifies that these documents comply with
