EXH[BIT B — PERFORMANCE MONiTORING <br />MUNTROSE COUlY'TY <br />Water Sapply Reserve Account Grant <br />Perfarmance Monitoring Provisinns <br />Statutory Rcquiremeats <br />Each personal services contract entered into pursuant to this code with a value of one hundrec� thousand dollars or more <br />shalt contain <br />(a} Performance measeires and standerds developed speaificaliy for the coritract by the governmentat bady administering the <br />contract. The performance measures and standards shali be negotiated by the governmemal bqdy and the vendor prior to <br />execution of the contract and shall be incarporated into the contrac� The measures and standatds shali be used by die <br />governmentaf body to evaivate the performance of the governmentai body and the vendor under the contract. <br />(b} An accountability section that requires the vendor to repart regularly on achievement of the perfarmance measures and <br />standards specified in the contract and that allows the govemmental body to withhold payment until successful completion <br />of ail or part af tfie contract and the achievemenE of established performance standards. The accountabitity sextion shall <br />include a requirement that payment by the governmenEal body to the vendor shall be made without delay upon successfut <br />completion af all or any part of the contract in accordance with the paymeni schedule specified in the contract or as <br />otherwise agreed upon by the parties. <br />(c) Manitoring requ'srements that specify haw the governmentat body and the vendor will eva�nate each others' <br />perfarmance, inctuding progress reports, sits visits, inspections, and reviews of perfarmance data. The governmentai body <br />shail use one or mare monitoring processes to ensure that the results, objectives, and abligatiatt►s of the contract are met <br />(d) Methods and mechanisms to resolve any situaCion in which ihe governmental body's manitorin� assessment determines <br />noncompliance, includiag termination of the contract. <br />Statutory Requirements <br />For each personat services contract with a value over $100,000, the individual selected by the state agency or institution of <br />higher edueation {iHE), pursuant to CRS §24-103S-I01(3}, shall monitar the contractor's wotk under the eontract and <br />shall certify as to whether the contractor is camplying with the terms of the contract p�rsuant to CRS §§24-203.5-I01(5). <br />(a) i'erformance measures and standards develaped specificatiy far the contract by the gavemmental bady administering <br />the contracG The performance measures an@ stancierds shali be negotiated by the gavernmenta�l bady and the vendor prior to <br />execution of the contract and shall be incorparated into the contrack.lfie measures and stanctatds shalI be used by the <br />governrnental body to evaluate the performance af the governmental body and the vendor under the contract <br />(b) An accountability section that requires the vendor to report regu3arly on achievernent of the performance measures and <br />standards specified in the cantract and that allows the governmental body to withhold payment until successful completion <br />of all or part of the contract and the achievement of established performance standards. The governmental body <br />shall use ane or more manitoring pr�esses to ensure that the results, objectives, and obligatioins of the contract are rnet <br />(d) Methads and mechanisms to resotve any situation in which the governmental body's moniWrin� assessment detennines <br />noncompliance, inctuding termination of the contract. <br />Performance Monitoring Standards <br />Performance monitoring for this contract shall include the foltowing: <br />(a) Performance rneasures and standards: The grantee shait fund a feasibility study af multipl� reservoir sito options <br />inctuding two potentia! new dam sites and the enlargement af ane existing dam in west Mantrose County. Grantee wiH <br />produce detailed deliverables for Tasks l as specified in Exhibit A. Grantee shatl maintain recieipis for ali project eacpenses <br />and dacumentation af the minimvm in-kind caninburions per the bud�et in Exhibit A. Per WSRA Criteria and Guidelines, <br />retainage of 10°fo of the grant funds shali be withheld until receipt of the finai report and all other deliverables. <br />Page 1 of 2 <br />
