Online July 2016 <br /> Permitting <br /> The construction of the Drop 5 Hydropower Project requires compliance with the <br /> following local, state and federal, environmental, cultural and paleontological resource <br /> protection laws and regulations including: <br /> 1) National Environmental Policy Act (NEPA) Compliance: The NEPA sets up <br /> procedural requirement for all federal agencies to assess environmental impacts <br /> associated with all federal actions. Reclamation served as the lead federal agency for <br /> determining NEPA compliance and evaluating all technical information. <br /> •T&E Plant Survey: The UVWUA hired Bio-Logic, Inc. to complete an endangered <br /> and/or threatened plant species survey. There are no occurrences of clay-loving wild <br /> buckwheat or Colorado hookless cactus in the project area. <br /> •T&E Animal Survey: The Bureau of Reclamation completed a T&E animal survey for <br /> the project as part of their NEPA Compliance assistance. <br /> •Environmental Assessment: The Bureau of Reclamation Western Colorado Area Office <br /> will complete an environmental assessment for the Drop 5 Hydropower Development <br /> Project. A Categorical Exclusion Checklist(CEC)will be completed by Reclamation. <br /> 2) Clean Water Act (CWA) Compliance: An evaluation will be conducted by <br /> Reclamation to determine that there is"no impact"to wetland and riparian resources. <br /> 3)National Historic Preservation Act(NHPA)Compliance: A Class III cultural resources <br /> inventory of the Drop 5 project area was completed by Alpine Archeological Consultants <br /> Inc., in October of 2013. Reclamation completed consultations with the Colorado State <br /> Historical Preservation Office under Section 106 of the NHPA. All occurrences will be <br /> mitigated or avoided.Copies can be provided upon request. <br /> 4)Lease of Power Privilege(LOPP):The UVWUA is working directly with Reclamation <br /> to obtain a LOPP&Funding Agreement from Reclamation. <br /> 5)Other Agreements or Easements: The Drop 5 Hydro Project is situated entirely within <br /> Reclamation lands. <br /> 14 <br />
