The United States shall exercise best efforts to procure sufficient funds to satisfy this <br /> provision. <br /> 23. Upon completion of construction or reconstruction of the herein described facility, <br /> the United States agrees to restore the land, as near as possible to its original condition, <br /> unless otherwise agreed to in writing by the State Land Board, subject to the availability <br /> of funds for this purpose and to applicable law. The United States shall exercise best <br /> efforts to procure sufficient funds to satisfy this provision. <br /> The United States agrees to abide by the terms and conditions set forth in said paragraphs 8, 21 <br /> and 23 of Right-of-Way 2612, Book 26, as revised and set forth herein. <br /> 3. Unless otherwise set forth, all terms and conditions contained in Exhibit A of this <br /> assignment of Right-of-Way which apply to the Conservation Board shall be understood to apply <br /> to the United States for purposes of this assignment. <br /> 4. In case this Right-of-Way is terminated for any cause whatsoever,the State Land <br /> Board shall own all improvements described in paragraphs 6.A., 6.D., and 6.E. of Right-of-Way <br /> No. 2612, Book 26, and the United States shall own improvements described in paragraphs 6.B. <br /> and 6.C. of Right-of-Way No. 2612, Book 26 unless otherwise agreed to in writing by the State <br /> Land Board. <br /> 5. The Conservation Board, its contractors, agents, or employees shall not be liable <br /> to the United States, its agents, employees, assignees, subtenants, invitees,patrons or any other <br /> person whomsoever, for injury to or death of any person or damage to or loss of property in, <br /> upon or adjacent to the land occupied by said Right-of-Way which may arise by reason of or in <br /> connection with the United States' development,use or occupancy of the subject land during the <br /> term hereof, nor the development,use or occupancy thereof by any persons doing so by, through <br /> or under the United States or with its permission,express or implied. <br /> 6. Any notice which may be given by the United States to the Conservation Board <br /> may be mailed registered mail to: Colorado Water Conservation Board, 721 Centennial <br /> Building, 1313 Sherman Street, Denver, CO 80203, or such other address as the Conservation <br /> Board shall furnish to the United States in writing and in advance of giving such notice. <br /> 7. By their signatures, the State of Colorado, acting by and through the State Board <br /> of Land Commissioners(the State Land Board), and acting by and through the Colorado Water <br /> Conservation Board, and the United States of America, Bureau of Reclamation, acknowledge <br /> and accept the modifications to the assignments of Right-of-Way Nos. 2612, Book 26, as <br /> originally granted. <br /> IN WITNESS WHEREOF,the parties hereto have signed their names the day and year <br /> first above written. <br /> Page 3 of 4 <br />
