1. Trigger discussion on possible cooperative measures if a resource is <br /> threatened. <br /> 2. Trigger discussion on possible non-binding mediation of disputed issues <br /> (requires a 5/6 super-majority vote), and <br /> 3. Trigger discussion on possible termination of the SG Plan (punting the <br /> W&S management back to the BLM) (requires a 5/6 super-majority vote). <br /> V. New projects. <br /> A. Unlike programs such as the 15-Mile Reach PBO, the Plan does not "rubber- <br /> stamp"new projects. However, the Plan does not provide the same level of <br /> resource benefit, or impose the same level of obligations on water users, that are <br /> provided by the 15-Mile Reach PBO, <br /> B. Instead, the Plan provides a reasonable level of expectation for new projects <br /> regarding ORV protective measures. Certainty is not guaranteed; but the Plan <br /> provides more certainty than would exist under a BLM suitability determination. <br /> C. The Plan provides a single-forum for new project proponents to discuss and <br /> propose mitigation measures with interested stakeholders. In the absence of the <br /> Plan, project proponents would face multiple bites at the apple. <br /> VI. Miscellaneous. <br /> A. The SG will include an appendix to address the Eagle River MOU. The appendix <br /> states in part that: <br /> 1. The ERMOU Project has been cooperatively configured to avoid or <br /> minimize environmental concerns and will be constructed as an alternative <br /> to the federally permitted Homestake II Project. Successful <br /> implementation of the ERMOU Project is important to meet the current <br /> and future water needs of both East Slope and West Slope ERMOU <br /> parties. <br /> 2. The modeling or other assumptions underlying the Segment 7 Resource <br /> Guides...will incorporate the depletions from the ERMOU Project, which <br /> will not exceed an annual average of 30,000 acre feet. <br /> B. Participation in the SG Plan will help to address conflicts in the SWSI Non- <br /> consumptive needs assessment process. In addition,participation will open lines <br /> of communication and foster good will among all of the stakeholders. <br /> Page 2 of 2 <br />
