1. PARTIES
This Grant Ageement (hereinafter called "Grant") is entered into by and between Plum Valley Heights
Subdistrict of the Roxborough Water and Sanitation District, 6222 N. Roxborough Park Road, Littleton,
Colorado, 80125 (hereinafter called "Grantee"), and the STATE OF COLORADO acting by and through the
Department of Natural Resources, Colorado Water Conservation Board (hereinafter called the "State or
CWCB").
2. EFFECTIVE DATE AND NOTICE OF NONLIABILITY.
This Grant shall not be effective or enforceable until it is approved and signed by the Colorado State Controller
or designee (hereinafter called the `Bffective Date"). The State shall not be liable to pay or reimburse Grantee
for any performance hereunder, including, but not limited to costs or expenses incurred, or be bound by any
provision hereof prior to the Effective Date.
3. RECITALS
A. Authority, Appropriation, and Approval
Authority for the agency entering into this Contract arises from Colarado Revised Statutes (CRS) §39-29-
109(2)(c), §37-75-104(2)(c) and §37-75-102 et al., and Senate Bill 06-] 79 adopted by the 2006 General
Assembly, and a sufficient unencumbered balance thereof remains available for payment. Required
