the District, Douglas County, Jefferson County, the State, or any political subdivision of the
<br /> State other than the Subdistrict.
<br /> (b) Levy of Ad Valorem Taxes. For the purpose of paying the principal of and interest
<br /> on the Note when due, respectively, the Subdistrict Board shall annually determine and certify to
<br /> the Board of County Commissioners of Douglas County, a rate of levy for general ad valorem
<br /> taxes, which levy may not exceed fifty mills, on all of the taxable property in the Subdistrict,
<br /> sufficient to produce an amount as may be necessary to pay the principal of and interest on the
<br /> Note when due, respectively, and the obligations of the Subdistrict evidenced by the Note. In the
<br /> event the revenues generated by the imposition of the limited mill levy provided for in this
<br /> Section 4(b), are not sufficient to pay the principal of and interest on the Note, when due, the
<br /> Subdistrict Board shall impose such user rates and surcharges, as further described in Section
<br /> 4(e), to generate revenues sufficient, when taken together with available property tax revenues as
<br /> limited herein, to pay the principal of and interest on the Note, when due. The general ad
<br /> valorem taxes levied pursuant to this subsection, and revenues generated by the imposition of
<br /> charges and fees described in Section 4(e), if any, when collected, shall be deposited in a debt
<br /> service account to be applied solely to the payment of the principal of and interest on the Note,
<br /> and the obligations of the Subdistrict evidenced by the Note, and for no other purpose until the
<br /> Note, including principal and interest, is fully paid, satisfied and discharged.
<br /> (c) Appropriation and Budgeting of Proceeds of Ad Valorem Taxes. To the
<br /> extent necessary to pay the principal of and interest on the Note, moneys received from the
<br /> limited general ad valorem taxes levied pursuant to subsection (b) of this Section are hereby
<br /> appropriated for that purpose, and all amounts necessary to pay the principal of and interest on
<br /> the Note due, respectively, and the obligations of the Subdistrict evidenced by the Note, in each
<br /> year shall be included in the Subdistrict's annual budget and appropriation resolution or other
<br /> measure to be adopted and passed by the Subdistrict Board for such year.
<br /> (d) Certification to County Commissioners. It is hereby declared that, if the
<br /> Subdistrict does not otherwise determine and certify to the Board of County Commissioners of
<br /> Douglas County a rate of levy for general ad valorem property taxes as required by subsection
<br /> (b) of this Section, the foregoing provisions of this Section shall constitute a certificate from the
<br /> Subdistrict Board to the Board of County Commissioners of Douglas County showing the
<br /> aggregate amount of ad valorem taxes to be levied by the Board of County Commissioners of
<br /> Douglas County from time to time, as required by law, for the purpose of paying the principal of
<br /> and interest on the Note when due.
<br /> (e) Rate Covenant. Until the principal of and interest on the Note have been fully
<br /> paid, satisfied, and discharged, the Subdistrict covenants to the CWCB to establish, levy, and
<br /> impose such charges and fees as necessary, taken with any available ad valorem property tax
<br /> revenues and other legally available revenues, to cover the expenditures for operation,
<br /> maintenance and repair of the Subdistrict's facilities.
<br /> (f) Other Legally Available Revenues. In setting the rate of levy for general ad
<br /> valorem property taxes required by subsection (b) of this Section, the Subdistrict Board may, but
<br /> shall not be obligated to, consider other revenues legally available to the Subdistrict for the
