BENEFICIARY: COLORADO WATER CONSERVATION BOARD DATE OF DEED OF TRUST: NOVEMBER 13,2012 RECORDED DATE OF DEED OF TRUST:JANUARY 31,2013 COUNTY OF RECORDING: WELD RECORDING NUMBER: 3906910(2 PAGES) LOAN CONTRACT: LOAN CONTRACT No. CT2015-051 (C150338) PROMISSORY NOTE: $1,336,230, 1.75% per annum for 30 years COLLATERAL: An undivided one-hundred percent (100%) interest in WATER RIGHTS consisting of Certificate No. 832 for two (2) shares of Western Mutual Ditch Company, decreed in Case Number CA6009, per Amendment No.1 to Loan Contract CT2015-051 (C150338), the AMENDMENT'S attached APPENDICES and the DEBTOR'S RESOLUTION (APPENDIX E), dated April 14, 2015. This Amendment to ORIGINAL DEED OF TRUST is between the Grantor and the Public Trustee of the County, State of Colorado. The ORIGINAL DEED OF TRUST was recorded to secure repayment of the indebtedness evidenced by the LOAN CONTRACT and PROMISSORY NOTE between the Grantor and the Beneficiary. Grantor and Beneficiary have agreed to amend the ORIGINAL DEED OF TRUST to reflect the change of pledged collateral. NOW THEREFORE, the CWCB and Grantor agree that: NOW THEREFORE, the CWCB and Grantor agree that: 1. This AMENDMENT TO DEED OF TRUST, APPENDIX C, AMENDMENT 1 t0 CONTRACT CT2015-051 shall replace and supersede the DEED OF TRUST dated November 13, 2012, attached to the ORIGINAL CONTRACT as APPENDIX 4a and incorporated herein by reference, recorded January 31, 2013, reception number 3906910 (County filing number). 2. The Grantor executed a Promissory Note dated November 13, 2012, to secure the repayment of the indebtedness evidenced by Loan Contract No. CT2015-051 (dated December 12, 2013) be repaid to the State of Colorado for the use and benefit of the Department of Natural Resources, Colorado Water Conservation Board ("CWCB") the beneficiary herein, whose address is 1313 Sherman Street, Room 718, Denver, CO 80203, payable in annual installments, in accordance with said original Promissory Note, or until the loan is paid in full. 3. In the event of any conflict, inconsistency, variance, or contradiction between the provisions of this amendment and any of the provisions of the original deed of trust, the provisions of this amendment shall in all respects supersede, govern, and control. 4.
