ATTORNEY - CLIENT PRPALEGE <br />JOINT DEFENSE PRIVILEGE <br />PRIVILEGED & CONFIDENTIAL <br />SCOPE OF WORK <br />A. BACKGROUND: <br />Groundwater Appropriators of the South Platte River Basin, Inc. (GASP) is <br />proposing to construct a reservoir near the Town of Ovid, Colorado. The reservoir <br />is intended to provide augmentation water to replace out -of- priority depletions <br />caused by diversions of ground water from wells in Water District 64 owned by <br />members of GASP. GASP has obtained a commitment for a loan from the Colorado <br />Water Conservation Board (CWCB) construction fund. During the funding <br />discussions, it was suggested that some of the water stored in the reservoir could be <br />made available for purposes in addition to augmentation of GASP wells. For <br />example, the State of Colorado and a variety of water user groups are in the process <br />of constructing facilities to reregulate flows required by the Cooperative <br />Agreementfor Platte River Research and Other Efforts Relating to Endangered <br />Species Habitat along the Central Platte River, Nebraska, Between the Secretary of <br />Interior, and the States of Nebraska, Wyoming, and Colorado, referred to as the <br />Tamarack Plan. The two projects will operate at the same time and in the same river <br />reach. The purpose of this study is to determine how the two projects can be <br />operated to increase the benefits of both projects. The work product resulting from <br />DRAFT.
