6.0 INSTITUTIONAL FEASIBILITY <br /> 6.1. STATE ENGINEER APPROVAL <br /> There is no requirement to seek approval from the State Engineer for construction of this <br /> project. The Company will coordinate with the Division 2 Engineer's Office about the details of <br /> the project and will incorporate feedback received from their office. <br /> 6.2. PERMITTING <br /> A summary of other possible permit requirements is provided below. Possible permit <br /> requirements and current status are listed below. <br /> 1. Bent County Permits: We are not aware of any permit requirements for this project in <br /> Bent County. <br /> 2. Fugitive Particulate Air Pollution Emission Notice/Control Plan Permit with the <br /> Colorado Department of Health and Environment: The construction contractor <br /> may be required to obtain this permit, which is a routine permit required for most <br /> construction projects. <br /> 3. Stormwater Discharges Associated with Construction Activity Permit with the <br /> Colorado Department of Health and Environment: The construction contractor <br /> may be required to obtain this permit, which is a routine permit required for most <br /> construction projects. <br /> 4. Nationwide Maintenance 404 Permit: This project is for the repair of an existing <br /> structure by an agricultural entity to further `normal farming' activities. A 404 permit is <br /> not anticipated for this project. The Company will request written verification of this <br /> interpretation from the US Army Corps of Engineers Pueblo Regulatory Office prior to <br /> beginning construction of this project. <br /> 5. Temporary Construction Easement <br /> A temporary construction easement may need to be negotiated with the <br /> landowner(s) for staging and stockpiling and access during construction. <br /> September 2014 Draft <br /> Page 117 <br />
